The adult has a child's mind, the child has an adult's mind. Who's the rapist?

Do we hate minds with higher awareness taking advantage of minds with lower awareness or do we hate bigger, more developed bodies being together with smaller, less developed bodies? Do we collectively hate the concept of adults with children because it is akin to a waste of sexual resources (as in the man or woman wasting their reproductive potential). If all human beings were equally intelligent from birth but not equally developed, would it be equivalent to homosexuality?

I'm asking because I want to know if it has to do with physicality or mentality. Because I'm trying to argue against a child with a mind superior to most adults being unable to decide who they want to sexually interact with amongst adults or other children with developed minds I cannot see it as anything but disgusting, gross, and ugly... but not immoral.

What happens if the child is so advanced that they're in the 99.999th percentile of all human intelligence? Wouldn't that mean that they'd be more conscious than nearly everyone in this planet, making us children in comparison? Wouldn't that mean that a child, in theory, could be the world's biggest pedophile since the child has no peer with which to sexually interact with?

If two sober people have sex, consensually, it is OK.
If two drunk people have sex, it is not consensual.
Non-consensual sex is not OK, whether it's by force or because you are entirely too confused to make proper decisions.

Even if the adult can be proved to have a child's mind, then that still doesn't make it OK, because it's like two drunk people having sex. But why do we imprison the adult and not the child as well? What if the child initiated it?

Who is to blame in that situation? Why is it that if a drunk man and woman have sex, only the man can be charged as a rapist?

If two rapists rape each other, do we imprison both of them? Haven't they punished themselves by being raped while raping someone else?

If a child rapes an adult by force, and then the adult rapes the child, why do we imprison the adult only? What if a 5 year old kidnapped your parents and then your parents escaped and revenge raped the 5 year old? Who is to blame?

It may be necessary for us to produce a distinction between the apparent raw intelligence you're alluding upon the behalf of remarkably developed adolescent, and the emotional development and growth that seems to largely accompany experiences while one grows older.

In that regard, a more holistic approach that encompasses these and other angles may be of more use in your tackling this issue.

If a murderer has the intent to murder you and you then have the intent to murder them after they've put their weapon down, who is the murderer? Once you are no longer in danger, you are the murderer.

Let's say the serial killer STILL had the intention to murder you even after they lost their weapon, but were completely unable to do so and you were fully aware (as caught on video). If you kill them and then their weapon fires (because they set it and forget it so that if they died, you'd be murdered), are both of you murderers? Do we imprison both of you even though both of you are victims and both of you are murderers?

Can both families treat the other families as families of a murderer?

Should we imprison the corpses of dead felons so that their families or loved ones or anyone who cares about them is unable to bury, cremate, or cryogenically freeze and destroy the body as the felon would have wanted? Would that be ethical?

I swear all I had was some alcohol a few hours ago. It makes me pretty loopy. You should hear the songs I've singing inspired by the drinks I've been drinking.

When I get drunk/high/anything, I have to carry around a digital voice recorder everywhere I go because I have so many song and random ideas. I have hours of singing and random joke ideas recorded. I'm going to be famous one day, there is no doubt in my mind.
