tell 'em to fuck off unless you're breaking some part of the ISP contract about the amount of traffic (if you're exceeding limits of if they have any vague clause about "big amounts of traffic"). just to be sure of what you're doing and if you have any kind of spyware/adware using your bandwidth, run anti-spyware programs and install a program for measuring your internet activity.

and what Arbiter said.

In addition, you must ensure that your activities do not improperly restrict, inhibit, disrupt, degrade or impede Comcast's ability to deliver the Service and monitor the Service, backbone, network nodes, and/or other network Services.

To answer some of the questions I've read...

I'm with shaw, as far as isp goes.

I'm quite certain its not adware, or spyware, because I have use a firewall, norton, adaware, and spy sweeper regularly. Also, when I do have mozilla, and filesharing, and any other thing that utilizes the internet closed, theres no (or extremely little) activity shown on the firewall meter, and the send/recieve lights on my modem.

Anyways, I emailed them back and let them know the truth, which is that I had a virus, which both utilized my bandwidth while it was in effect, and after I had gotten rid of it, I had to use quite a bit of bandwidth to recover from the damages.

I still don't get what the big deal is, and why they are contacting me about it though, because I really dont see how I was using it sooo much that it was a problem, as I only dled say 10 to 14 gigs in the month. 6 or 7 of which would have all been in 32 hours or so.

Oh...shit I just read the user agreement theing and...
quote:
You must comply with the current bandwidth, data storage and other limitations on the Services.

Users must ensure that their activity does not improperly restrict, inhibit or degrade any other customers use of the Services, nor represent (in the sole judgment of Shaw) an unusually large burden on the network itself, such as, but not limited to, peer to peer file sharing programs, serving streaming video or audio, mail, http, ftp, irc, dhcp servers, and multi-user interactive forums. The guidelines for Bandwidth Usage/month for each service package are the following: Shaw High-Speed (with Xtreme-I) - 50 GigaByte; SOHO - 50 GigaByte; Professional - 70 GigaByte; Business - 100 GigaByte (combined download and upload). Business services which are combined with the Xtreme-I upgrade retain the stated Bandwidth Usage/month guidelines. The guidelines for acceptable web site traffic include 2 GigaByte/month for SOHO, Professional, and Business hosting packages.

Residential Shaw High Speed and High Speed Lite services do not have specific guidelines of this nature as the Service is not intended for business applications. Shaw reserves the right to set specific limits for Bandwidth Usage and charge for excessive Bandwidth Usage for residential Services at any time. In addition, users must ensure that their activity does not improperly restrict, disrupt, inhibit, degrade or impede Shaws ability to deliver the Services and monitor the Services, backbone, network nodes, and/or other network services.

So the big bold service is what applies to me...it says that they can limit my usage at any time, and it also says that they can charge for excess usage...but in the email it didnt give me a limit, or say i had breached anything?? So I still dont get what they are trying to say. I just hope they arent going to charge extra on the bill...my parents will go fucking nuts.

pick up the phone and call customer service/technical dept. they might give you "unoffical" limit. they usually give themselves plenty of latitude to do what they need to do in the user agreement. just play it straight with them and don't abuse your bandwidth and you should be ok.

LMFAO Fundy.

If I was doing it for real firstly I'd realise that it's probebly an auto email.

And if it requests a reply play it nice, you catch more with sugar than salt.

Further to your email I wish to reassure you of my confidence that none of this bandwidth usage is related to any form of negligence on my part. I note your concern and have verified my own adware/firewall provisions and they all appear to be up to data.

However if this email relates to some form of bandwidth limitation on this account, I was not made aware of this at the time of initiating the user contract and obviously I would endeavour to adhere to any form of formal bandwidth limitations on this account.

most uk isp's are imposing limits on new customers and bringing them into older ones (Like me) they've had to give us 6 months notice so from May 2005 i can only use 30gb a month, inc up/down etc. The email they sent was funniest tho

"We know you'll never use anything like 30gb a month"

coming days after i did about 25 in 4 days they don't have a clue

ISP's do have the right to cut you off, block ports, throttle bandwidth, cap you, etc. Read the agreement, as they can 'legally' do it.

I just told them I got a virus.

Then I found out how to moniter my bandwidth and I realized 20 was the soft cap, and I had already used up 18 gigs. So I have 2 gigs left for the month...
