I was in shock because i did not expect something like this to happen, especially at 4am. It looked like there was not much damage done to my car at first but when they inspected it the whole trunk underneath was smashed so it cost $4500 to fix. I also got a neck and a knee injury so i went for physiotherapy. Then next year after renewal my insurance rate went up (because i was a risky driver? i dont know).

So this accident happened a year or two ago? when was the one before? Was the one before your fault?
Something to consider.... two years ago all rates went up.

I waited till 25 to buy a car for insurance reasons! I simply wasn't gonna fucking pay ~$3,500-$4,000 for insurance a year!

Crazy.

My rates now I am content with, thus I decided to buy a car (finally)!

But let me get this straight, if I'm going straight through a lighted intersection and the guy opposite me is turning left and he could indeed make it if I didn't accelerate, but I did and hit him, they're still at fault?

That is correct...the Government set out the No-Fault rules and the rules do not take into consideration the speed you are travelling at....you could be going mach 1 through the intersection and if the other driver turns left infront of you he is at fault.

I am exaggerating here....as the other driver could fight the ruling of the No-Fault Chart as you probably would have been charged with careless driving at the least. IF you dispute the ruling then liability would be based on the General Rules of the Road.

In addition to Scott's post above.... it does not need to be a lighted intersection.... if any person is turning left across you path at any time in any place and you collide then they are 100% liable/at fault (provided you are not charged with a criminal or some Highway Traffic Act offence pertaining to the operation of the vehicle contributing to the collision.... ie. running from the cops, running a read, reckless driving).

To correct Scott's post... a careless charge (in this instance) may not make you at fault as it is secondary to the "left turn not in safety" charge the other driver would likely receive.

you are correct...the left turn would still be at fault for the accident....if the charge was something greater then the left turn may not be found 100% at fault.

Well if you do....make sure you are injured....I'd be more then happy to do your housekeeping for $100.00 a week....and I'm sure some attendent care would be needed as well.

I am happy to report the the insurance companies practice equal opportunity bad clauses.
My policy has a clause that states "female drivers under 25 are not allowed to operate the vehicle"
