Only if stated in some kind of contract. Someone can choose whether or not to select a gay/bi/straight roommate. It's their apartment. And it's not like he's saying "no straights allowed" but he would prefer someone gay/bi.

Like on Family Guy..."we weren't allowed to say no Portugese...but uhh...no Portuguese". lol
