So if my car went backwards down a 1000 foot hill of ice this morning, does that count?

I HATE ROUTE 93 IN COLORADO! They don't salt or plow it and there are always 10-15 accidents along the same 20 mile stretch. I finally found a detour that takes me 20 mins longer but I'm alive at least!

I didn't say he had to file a lawsuit at all....I suggested he pursue an injury claim with him automobile insurance company as is his right.

Besides, the claim would never go to litigation...the insurance company and the legal rep. would more then likely come to some agreement before it ever went to litigation.

you never should have been on his property in the first place in this case.


You would still have a right to file a lawsuit against your neighbour....even if you were not suppose to be on the property...wether you win the lawsuit or not is another thing.

Property owners have a responsibility to anyone who enters the property wether invited or not. You are not allowed to have hidden hazards that could cause injury to people who enter the property. In order to win any lawsuit the property owner would have to been negligent and that negligence would have to be the cause of the injury. If the property owner did something they shouldn't have done or failed to do something they should have done to prevent the incident from happening then they could be held liable for the injuries. For example....if the neighbour was pouring buckets of water down the driveway and caused it to be an ice ramp...more then likely they would be considered negligent if someone fell while trying to walk on the driveway.

Agreed, it does suck.

I fell through the ice at the confluence of the Yellowstone and Missouri rivers. It was damn cold, hard to get out and I ended up smelling like crap (the water was muddy) and my clothes turned to ice the moment I stepped on to the shore.

I didn't know that if you fell and hurt yourself getting out of your own car you could file a claim.

I've got a claim right now where the insured was opening his car door and two dogs attacked him from behind. His injury claim is going through the car insurance because he was opening his door and that is considered normal use and operation....doesn't matter that the dogs had nothing to do with the car at all.....stupid loop hole.

Unfortunately, land mines tend to make people go boom.....the good news is they probably won't live so they won't be able to sue you.
