i've heard dozens of tracks that have samples in the past year, and I doubt any of them got clearance, and there has been no legal action against them. For EDM I think the philosophy is that it would cost labels and sample owners too much money and time to make claims on the samples. The only time you might see a claim is if the track makes tons of money. given the lack of action accross the board on the average sample using track, the label or sample owner would really have to have a personal gripe against you to make noise about it in a legal forum.
