according the "just deserts" theory, this sort of punishment isn't effective. it talks about how each individual (even criminals) are all different and by punishing one a certain way, isn't going to make all the others learn their lesson.

I watched an episode of that show one time where they played clips from about 10 of those guys where they asked them if they came to have sex with the girl and they all said "no, no way" or "I just wanted to talk" or whatever. Then they played clips of the exact same 10 guys and they asked if they had condoms with them and they all said "yes"

Are you seriously just not reading? Or thinking? I have not said that they should not be punished or incarcerated for what they've done. I totally agree that it's pretty much the most horrendous thing that one person can do to another, and yes, I would be quite pissed if somebody I knew was raped. But just as there should be separation of church and state, there should be separation of emotion and state - justice is not there to exact revenge or to satiate your bloodlust - it's to protect specific instances from occurring again (however much it fails at that) through punishment. Just because the people are angry and want to see death does not make it right. Do rapists and pedophiles deserve any better? Of course not. But the satisfaction of deserving is not and should not be in the hands of the government nor should it belong to the desires of an angry mob of people who had fuck-all nothing to do with the situation but show their support of one another because they think that it elevates them to some incarnation of noble brutality.

honestly i generally agree. emotions shouldnt be involved in government nor be the determinate factor for things in life. theres just 2 things i cant stand and unfortunately they do get to me. this is one of them and the other is domestic abuse.

theres punishment and vengeance built into the system. Humans arent going to be able to change that. No matter how veiled in noble pursuits a legal system is, theres always a human element, and that human has emotions.

What you need to ask is if the benefits to punishment outweigh them going free.

Again, Im not seeing anyone actually arguing about putting them away or euthanizing them. its mainly that we should be crying out of our weiners or something while we do it.

that's where it's tricky. As "rape" in those cases can techncially be construed from a legitimate relationship if parents or someone else (or even the girl) finds out about it. The only problem would be what to do to legitimately punish abusers/rapists. Maybe We could buy some of Guantanamo & send the bastards there.
