He didn't get kidnapped ... The story is kinda long.

He went to Walmart to buy a flash drive. Didn't asked for a bag, and when walking out the machine started beeping. Security got him right away. Since he went all toked out... He got really nervous and couldn't find the receipt. The police got there fast and arrested him. He was booked at the central jail, but they transfered him somewhere else. His personal stuff wasn't sent over there. So less chance for him proving innocent. The attorney he got by the county told him to plead guilty... That it would be easier and better, so he did... He called our house from jail, but we don't get collect calls. So he called one of his other friends, and the girlfriend answered. She hates my bro a lot, and she was the only one that knew he was in jail. That fucken psycho scenester wanna be bitch, started texting me that my bro was kidnapped from a prepaid phone and asking for a ransom. The first two days I thought it was true. But, then later she started to attack me and talking shit about how I buy $400 pair of jeans. So it clicked, that the person wasn't from TJ. Plus they sounded it all white. I called the police dept., they told me it wasn't a threat... OK if the police had my bro on the system as a missing person, why they never told us he was in jail. We found out he was in jail, because one of his friends looked on whosinjail.com and he came up. The charges that my bro got first were burglary in 2nd degree with a bail of $30,000 . I think that was too high for just peti theft. Finally, they let him look and his wallet and found the receipt. They dropped the charges and let him go. I wonder if he can sue Walmart and Police. What you guys think?

I would sue the girl. And tell the police about her. What she did that made you call the FBI and all that stuff can land her in big trouble.

She won't learn unless something is done to her....so I would try to get her in trouble with the law as much as possible.

And just sue her for some money for the emotional stress she caused. Even if she's poor. Teach her a lesson.

Dude, so glad it all worked out. Sounds like a series of things all going wrong at the same time to let that happen.

By the way, it's a very serious FEDERAL offense to pretend you have someone held ransom - If she at any point contacted you demanding goods, services or money while you were under the impression that your brother had been kidnapped, then she is in real shit - especially so if the FBI got involved - by that I mean like mandatory jail time.

You bro could in theory sue wal-mart but if he was mashed at the time, your looking at a instant dismissal as they will just say he was behaving erratically. Also, he plead guilty, which still stands. Just because the authorities decided to not proceed with it, you would really want to get the guilty judgment reversed first, which would mean proving that lawyer coerced the plea out of him or explaining why he plead guilty when he was actually innocent.

All in all it's not difficult to do but would involve throwing some time and probably money at it. Ask a lawyer what they think, but IMO, the fact he was caned is a deal breaker.

Cant really sue someone for lying or not telling you something... And good luck proving emotional distress in court... The dumb bitch should get her ass kicked but legally there isn't anything there...

Sorry but not true. Impersonating a kidnapper is a federal offense and even though this was not a kidnapping itself, the FBI were involved because of the ransom demands and linked communications. This means that fraud was committed by this bitch and FBI will investigate it.

If she is charged, it is really really easy to sue her for any emotional distress caused. Just make sure you keep records (write a log of it) of all the times she made contact, and what she said. Even if your bro was mashed, the fact will still remain that she played on your families fears when you thought he was kidnapped. The fact you involved the authorities actually greatly strengthens your case.

Nail that bitch to wall.
