In general I am against any sort of regulation against voluntary exchange between a willing buyer and seller. All derivatives ultimately boil down to voluntary contracts between private parties..however I have no problem with certain types of regulations. If it can be shown that a firm takes the same asset and packages and repackages it multiple times..leveraging up with all sorts of fancy tricks to inflate the perceived value, then sells it to multiple buyers, this would be a clear case of fraud and shouldn't be allowed. When I was researching the silver market, I found the total number of outstanding paper claims to silver VASTLY exceed the physical supply that could be pulled out of the earth in 10 years..and all of these claims could be used to demand delivery at any time..so something is clearly amiss there. I think we need transparency more than anything. If regulation can accomplish this, go for it. |
Prohibiting people from trading is bad..but transparency is good.
