They quote that they have not filed a lawsuit against DC but against people who operate "Napster-like" networks on their campus.

The people who operated these networks used at least one DC Hub.
Here`s my two cents:
Since the day I found out how DC Hubs work I knew that this would be the final way to swap illegal files. Decentralized networks that can run on every PC out there. How would you ever stop this? This is unstoppable since you can`t shut down central servers like with Napster or AG.

it could be stoped by the isp's banning p2p software on their service......

ISP banning won't happen anytime soon - that's way too big of a fish with plenty of complications. Too many legalities.

how would they do that? there'll always be a loophole somewhere..
and jeez, people, why are you getting so worked up about this? let me repeat, it will not affect the EMC hub, cuz
1. they don't have a central server to shut down, so they'd have to go after individual hubs, EMC in our case (and oldo's essentials too, but that's another case)
2. they don't know EMC exists
3. even if they did, they don't know the ip
now, what could be potentially dangerous, is that RIAA could go suing ISPs so that they in turn would get anal on their customers for sharing mp3s and hosting hubs... but that's a risky case, because many ISPs, broadband in particular, depend on the users who download and share files. yet ISPs are pretty powerful too and have their own expensive lawyers to fight back, because for them file sharing = business.
what they COULD theoretically do (and what actually is true with some broadband ISPs in the former USSR, AFAIK), is CHARGE customers for the amount of data they download / upload. i really doubt that would ever happen in the US, but that's the case in Russia and Ukraine and i think it's working pretty well.
not that i'm giving anyone any ideas, i'm on 56k

Actually, in Finland some ISP's have already done this.
Needless to say they've been losing their clients ever since.
