to prove copyright you have to prove original works. the law IN AMERICA states that you have to copyright by paying an agency. over here you can prove copyright in music by simply sending yourself a CD of the original works via special delivery, getting a reciept and a date of originality.

now with pictures (to which the same copyright laws apply) you can prove original works with many other ways. one being original data information such as you have already mentioned, and the data from your camera proving that it is your camera that the pics were taken with.

so basically, unless you live in america, you dont have to pay to get a copyright, so long as you can prove that you did it first in a very convincing way. my advice would be to tell the bloke to fuck off, and then prove that you own the pictures by virtue of the GREAT BRITISH laws regarding the subject. im sure mag can find the applicable laws

The paying stuff is a bit different. That's normally for companies to use their original artwork/material for their business, so the paid copyright is a registered copyright or a registered trademark for a logo etc.

This means lots more legal stuff.

But basically it comes down to proof of original ownership. Agreed, its best to be registered etc or market, but there used to be a process where artists would seal a copy of their own work in an envelope and thenm send it to themselves, and not open it, so it was datemarked by the post office. With electronic publication the dates andstuff are stored on the jpeg, this is a bit more of a grey area, but he's just being a wanker, basically.

Bottom line is that without legal representation there isn't a lot you can do, however you migt wanna start posting the pics just about everywhere in the world, just to spite her.

Saying all this, because im not taking it any further i still appreciate all the time and effort people have gone into digging out info and facts and posting their knowledge on here and helping me with this, i really do appreciate it!!

I'll upload all 3 sets of photo's I took to some webspace.

get a really bad picture of her and spam it everywhere, on any message boards she goes on etc! e-mail it to all her friends!

I have been advised to wait for a letter from your solicitor to further this action. I have had a case drawn up by my solicitor ready to make a statement to hand to the courts if you wish to take it that far. Also, when taking the images did you have a signed letter of consent from Laurens parent/guardien allowing you to take such images? If not then going to court would not be a sensible idea as you would get investigated for underage/unconsented photography of a minor. This is a serious crime these days and the courts do not take it litely.

About that bit where he says i didn't have parentle consent.. what the fucks he talking about. i know for a fact he doesn't have parental consent to publish those photos of a 17 year old girl on his website because i know she hides her photo's from her mum n dad cos they don't know she does posing and stuff, and she didn't want them to know. so he's saying im doing something illegal where he's doing it worse. Its not as if the pics were "naked" or "indecent" so that attack he put towards me is utter bollocks. You can see for yourself on the complete collection of photo's that is now uploaded HERE

What should i say back to him? Im leaving it as it is now cos its just getting pathetic i think and its not worth any more time or effort!!

i think you can prove your point if you could be arsed to do so, but if you cant be arsed then you dont be.. just phone her parents and ask them if they know their daughter is publishing pictures of herself on some shitty website.

thats a fucking mint idea Eleni... i know her address i could easily pop a few photo's into an envelope and send them to her mums name for example so she opens them.. oh it would be so funny to see the whole families reaction.

That joint author stuff isn't actually relevant unless she took any of the piccies. He is touching on another issue tho - a Signed Model Release, which is normally used in royalty free imagery where the model signs a release form, effectively meaning she has no control as to how the imagery is used.

Anyway, the guys a dick. And dicks never win.

If u can be arsed, do the following - Design a fake club flyer using her as the background, print some out and scatter them loosely around her parents fronty lawn.

Deny all knowledge. Game over.
