Here too, when there are significant damages, especially with bodily injury. Not a scuff on the bumper. (I think--a while ago when I called the police after something was stolen from my car, they didn't seem to care). If the lady complains about a scuff, during the first snow storm of the season when there were hundreds of more serious accidents on the highway, I have feeling they'll say, "ching-chong-chung, lady, we don't care"

Fahad

Listen man i know exactly what you are going through. Its the worst feeling in the world.

The most important part is that you are Alive and well. yes no one likes extra financial burdens but hey its only money and can be made back. If you were injured no money in the world would help you.

So dont think about it too much cause it will only stress you out.
Remember these things happen for a reason and everything will be ok in the end.

Party UPPP!!

see u in Montreal buddy

with you not getting any of her info you are sort of shit out of luck because she can't contact you just her insurance. who the fuck knows, she may have no deductible and some sort of deal with her premiums.

i know that you want people to cheer you up so i will add as everyone has already that the most important thing is that you are ok.

I really do try to stay out of insurance talk on weekends....i really do....but Margs you are wrong.....that is not how insurance works in ontario.....in the old days before No-Fault Insurance that is how it worked....but No-Fault Insurance stopped that....and believe it or not....actually helped lower insurance premiums.

I will try to explain this situation as how it would work in insurance. Our crazy MoFo Fahad here.....slips into the ass end of this biatch.....well the Ontario Government set out a set of rules as to who would be liable for the accident. The adjuster for this lady would look at the set of rules and note that Fault determination Rule 6 (2) would indicate that Fahad was at fault. This would mean as long as Fahad's insurance company writes insurance in Ontario or is licensed to write insurance in ontario that her claim would be handled under the Direct Compensation Portion of the auto policy. Under this section of the policy her own insurance company would pay for her damages plus a rental car if need be. Normally there is no deductible for Direct Compensation claims however, in some cases there are. So after her vehicle is fixed and her insurance company has paid for the damages then the claim is over. Her insurance company would not go back after Fahads company.....that is why it's called no fault.....because no matter who is at fault...you only deal with your insurance company and your insurance company will make all payments with no subrogation.

What the government was thinking when they introduced this crazy way of handling things was that in the insurance industry there was a lot of money flowing between each company for subrogation of auto claims. With the law of large numbers theory it basically works out that company A is asking for the same amount of money as company B from each other. By stopping this subrogation it saved money on administration costs which gets reflected in the premiums we pay.

Is that because the costs to repair the damages were less than your deductible? Also, did the insurance co. record this as an at-fault accident for you? Because that's what I'm trying to avoid here. Same question goes for your second example...were both of these the other person's fault? If so, you're clear! I, however, am not.

And yeah, if she goes to her insurance co., I'm fucked either way! The accident WAS my fault, after all, so I'm prepared for that consequence (which of course, is not as severe as Malek made it out to be). By not reporting, there's a chance I can get away with it...I think...

Just to let you know....even if you don't make a claim.....and your insurance company finds out....it will affect your status.....it will still show as an at fault accident and you will see an increase in your premiums. Before you punch me out for saying that remember that when insurance companies determine what your premium will be they are trying to predict the likelyhood of you taking money out of the pool of money set aside for claim payments for people in your class rating. The biggest problem with insurance ratemaking is that its prospective not retrospective.

I have had 3 accidents so far with my bimmer (one of which was a hit and run...two of which were completely my fault) however never under any circumstances should you report it to the collision centre unless you are going through insurance. We got screwed once because we reported it but didn't know it got back to our insurance company even though we took care of it ourselves.

Also, body shops do not have to report anything and usually cut you a deal because you aren't going through insurance...well, i also happen to be a repeat customer and they know I can't drive for $hit.

Actually....it will cost you more to get it repaired when not going through insurance. The hourly rate that can be charged for insurance claims is about $15-$20 less then they can charge privately.

no recorded as an at fault accident because it wasn't my fault and the other people paid out of their pocket for the repair. $700 worth of quarter panel work.

the second unfortunately was big time my fault just like you. i rear ended someone. the reason why i pay insurance is for this type of accident. i paid an 800 dollar deducitible for 8500 worth of damage. good deal if you ask me. i don't know what is going to happen with my rates when i get the insurance renewed but i think i was paying an extra 4 dollars a year for a 9* rating protection where my first claim won't raise my premiums.

ok, well at least i know next time that i don't have to show anyone my insurance slips because it doesn't matter.

then by the looks of it you are in the clear fahad no matter what happens. just get your car repaired as quickly as possible and you are ready to roll again.

didn't get to an accident but my car broke down on its own- power steering- it was such a bitch to drive too- had it fixed today for only $ 525 - the mechanic did some other minor things as well but still that much $ b4 Christmas....uh.... painful

Posted by riskytrader on Dec-11-2005 14:25:

So how crasy is this? I was reading this thread yesterday and got a call from a good friend who said she just got rear ended because some idiot two cars in front of her pulled an illegal u-turn. The guy in front of her swerved out of the way, she managed not to hit him but the idiot lady behind her obviously wasn't paying attention to any of this and because of the icy conditions went slam right into her. She's okay thank god but it's just ironic to be reading the title of this thread and boom

This is why i would rather have a house than a condo.

besides doing engine work. I also do bodywork.

a few years back i got into a fairly nasty accident on the gardner W. 6 cars involved - my truck took the most damage. everyone was slamming on the brakes to slow down for an accident that just happend, i was slowing down enough but some guy just cut infront of me at the last second while i was hit from behind by a taxi. which pushed me into the guy infront of me - i took his rear bumper dead center of my rad/just above my bumper. then i spun and went into the guard rail. the entire front end of my truck was crumpled in.

after being towed to the accident center. turns out i had $8,000 damage on a truck i only paid $600 for. they wanted to scrap it, i said i was going to fix it. got into a big argument with a few of the cops. I had to sign a few legal waivers to release the truck. but i would have to bring it back after the repairs were made (I had a fat cop laugh at me and said it will never be on the road again) - and he says that if i bring it back he will check it himself.

3 days later i return driving my truck.

the same cops are there that i delt with earlier, but im looking for the fat cop. i find him having a coffee. he says he's not going to check it. so i yell at him for a bit (every $%#% name you can think of), and he checks the truck. - it passes.

my costs for repair (myself) - total $850
$300 for the tow.
$200 for a new rad.
$200 for misc parts
$150 for a 1988 Chev blazer (i have an 88 GMC Jimmy)

I wish i still had the pictures i took while i was repairing the truck. - i had to cut off the front of the body and had to pull the frame straight. so now, the front end of my truck is a chev while the rear end is a GMC.

LOL Marty, you're fuckin badass
..hell yes DA...can't wait!
...and thank you Kelly, babes, for your compliment (to the car AND me! <3)
