All right, I could see how they would lose cash because of marketing costs, but I don't see why the party would have to be canceled, wouldn't they be allowed to offer an exchange on the tickets for what ever they'll change the event name to, instead of having to refund everyone? That would really suck for them if they lose swirl, but I didn't buy an early ticket, and don't plan on spending 70$ on a ticket now, so not such a big loss to me, sorry :P

If you think about it, a name is not only four letters long... a lot of money is involved. If they lost the trademark for the name swirl, that name cannot appear on any ticket that have already been sold (pre sale), as well as having to change the entire theme by itself... In my opinion, if 514 has been sued for using the name swirl, the must pay for damages when it comes to advertizing... their site, the tickets, and all others. 514, if it is faced with that, will choose to cancel the show rather than deal with headaches... court battles tend to last a long time.

This is just what I think would happen, I'm not even sure they have been sued because I've not heard of it, except for this forum... the next 20 days should be interesting to see what happens...

I thought 514 was always the "owner" of the name?? What do you mean that there are two 514 production companies or something.

Did someone buy out 514 because in that case they buy all the trademarks that they own also. I really don't understand.

I know there's the pre and post Sona, before 514 completely took over.

how exactly can they be sued and cease promotion in 2 days, they've been using the Swirl trademark for 8 years, that's ridiculous, that would NEVER hold up in court.

I don't know if I should tell you this but...

514 buyed their old partners last June for 600 000$.
And they put Swirl and other trademark in garanty.
But now they don't have the money to finnish the payments so the old partners won in court and they are the owners of Swirl again.

Anyway, Cordeiro brothers were not alone when all these partys started, Driss, JC and Crazy Eddie were all 514 partners with the same % of parts than the Cordeiro brothers.

The name Swirl is from Crazy Eddie and at first, Swirl was much more better than now.

Now it's anything, before it was Techno and Hip-Hop.

Anyway, Driss and JC should get their money back because they worked too much for 514 for nothing.

There's no need to. Pre-paying by credit card is the safest way to guarantee your money's return if the event gets cancelled.
Unfortunately, those who paid for tickets to a recently cancelled event in Toronto by cash at the outlets got screwed- the promoters picked up the money to pay for things along the way, only 1/2 of it was returned, & I don't think they have any intention of replacing the money. Thos who paid by credit card were refunded immediately.

it's not cancelled yet...... if there's one thing I've learned and everyone else should have learnt so far, it's dont count on anything until you've heard the official word. We hear a lot of rumors first, not to say that many of them are true, but there have been a lot that didn't pan through. I'm sure they can work out a deal to pay $$ for throwing the party, instead of losing all the $$ from not throwing it.

This whole trademark fiasco is pure bullshit. Call the party something else, who cares. I sure as hell wouldn't care. With a lineup like that the party could be called "worst promoters of all time", and I'd still be there. If the party doesn't happen it's because of Popo nothing else.
