I would speak to the owner and ask that they provide you with their insurance information or else you will have to take legal action. I would also send them a letter requesting this information.

If that doesn't get you anywhere then report it to your insurance company. Businesses tend to take things a little more seriously if the insurance company is requesting this information.

We delivered a letter last week demanding repair and they flat out refused to deal with us and asked us to leave the property.

Our only option is to go to small claims. Our insurance company will not have any more success recovering the deductable - since the owner will not deal with us.

I am also hesitant to go through our insurance company as it may impact future insurance rates.

Its not a collision claim so it shouldn't impact future insurance rates. The insurance company will most likely have more success in recovery then yourself.

When someone is beign difficult then really the only options you have are to go to small claims court or deal with your own insurance company.

Having dealt with many business owners that are like this...I can feel your frustration.

the only lesson here is to never trust anyone with anything. and to fix the problem all you can do is take it up the ass from people because they have tons of lawyers in their pocket and you got nothing but a 1600 dollar repair on your hands.

i don't trust the courts to do the right thing, i don't trust the guy to do the right thing and basically people in general are made to take advantage of situations and not take the blame for their actions if they have a chance at it.

Not all people but yes, this is fucking awful. I can't believe they won't even speak to you about it. Unreal.

lol. just finished doing this.

it's quite a process. i guess we will see what happens. the thing with BBB is that they won't deal with stuff if it's been reported to small claims court. so i have to wait for a month for BBB to do their stuff. they probably won't do anything about it, so then i have to wait for small claims court to do their thing, which i trust won't do anything. and since i can't pay 1600 dollars, the car basically just sits there and rusts as the days and weeks and months go on.

i am just not sure if to go with insurance on this still. i know that will be a pain in the ass too but i think it may be quicker. first thing is first, waiting for BBB, i guess.

in all honesty, you are probably best to go through insurance. It shouldn't affect your rates any as its not a collision claim. I would suggest at least speaking to an agent at your insurance company or your broker.

Unfortunately, life is quite a bitch and also is extremely unfair. It's sad seeing bad things happen to good people, but it happens all the time, and EVERYONE has their issues and problems to deal with. Some people are just better than others at not letting life downturns affect them. I don't really believe that people who claim to be constantly happy are very happy, it's usually otherwise.

But, there are still a lot of great things to live for and look forward to. If everything was so easy and great; then, no one really would cherish and appreciate good moments.

Margs, I am sure you are upset about your car, and it totally sucks, but you will get over it, and it's not like it really affects directly - you will be short on $ for a while, would have to work a little extra - but it won't kill you! Just suck it up and hang in there...

Fuck, I had to give away my cat Batman of five years yesterday that I brought to Canada in a back seat of a car from the States. I am very upset and just blah, but life goes on and you gotta move on... Amen!

Margaret I'm sorry about what you are going through. Really I am. I know life isn't always fair but you have to trust at some point and not let things like this make you bitter or jaded. It doesn't always go from worse to worse. It may feel that way now, but something's gotta give and it will.

Now, because of all the input in here you've started something. It may cost you time, money and aggravation but stick to your guns and remain positive that the outcome will be in your favour. Things will turn out equitably for you. I really am a believer in this.

Yes there are people who will take advantage of you and not take responsibility for their actions. Yes it's hard to trust anyone because everyone is inherently in it for themselves, but I doubt everyone will sit there and take it up the ass...and I seriously doubt you or RJ would take crap or grief from anyone.

We've all gone through stuff but at some point we have to trust and know that our actions or reactions will make things right or better. For me, after having been happily married and then not. Going through ups and downs, sharing space with an untruthful, manipulative person...I've learned a lot. Now work, good friends, home and a fantastic fiance was my full circle.

Something good will come out of what you've started...and I really want this for you. Once this is over, both you and RJ can count this as just another experience which, if anything, has brought the both of you closer together.

Cheers

That's not true. I've asked a rep for our insurance company what option to take and I've always gotten an honest response. I've never had any rates go up for asking.

lol. actually, i got an estimate this morning and it's 1600 in damages.

the whole hood needs to be replaced, painted and blended with the rest of the car. the part itself is only 250 bucks but the painting and blending, headlamp readjusting add up to tons of labour costs. which could have been avoided if the guy just owned up to his mistake and fixed it.

Holy shit dude...

If you end up having to pay for this yourself, please go somewhere other than where you got that quote...

Cause $1600 to replace a hood........rip-off!!!

loooool.

so this morning i was awakened at 6:30 in the morning by a cop at the door.

my car has been involved in a failure to remain accident. a guy ripped the rear end off my car. parked up the road and ran away according to witness.

They suspect the guy was intoxicated as he hit a few other cars on the street. He basically crashed the car and then got out and ran away leaving his keys in the ignition and stuff in the car. The story sounds like an episode of COPS.

Luckily a neighbor was getting home from the night shift and saw it all go down at 5:30 and called the police.

The door-bell being rung by the police at 6:30 AM on a Sunday was a very sketchy experience.

Oh my gosh, that would be so scary opening the door to a cop! Margs that car sounds like it's bad luck!
