Exclamation Please Help Me!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Ok heres the deal. Last week i got nailed for doing 54 over the limit on the 400 south of Barrie (yeah i know im an idiot). But heres the thing, i was only going 140.....tops. I didnt ask to see the radar since i was high as a kite and just wanted to get the fine and be on my way. He handed me the ticket, and he was on his way. I open it up to check the fine.....no fine.....just a court date, in Barrie (which is 2.5 hours from my house) with the charge of careless driving. 6 points, and if convicted i checked with my insurance and it'll go from $4600/year up to almost $10000. Any suggestions as to what i can do to lower the penalty!?!?!

when I got nailed for speeding, I took it to court, plead guilty to a lesser charge. My fines dropped from a combined total of $960 to $50 and I didn't lose any demerit points.

But from the sounds of it, your best bet is to get a lawyer. You don't want to screw around with demerit points. I would rather pay a hefty fine than lose demerit points.

Good luck with that

JUSTICE OF THE PEACE!!!!!

I have a friend who got nailed for doing 160 in a 80, AND for making an illegal right turn. He went to the justice of the peace, and the first thing they did was throw out the first ticket simply because it wasn't filled out right, and lowered his other ticket to $35. he would have had to pay $250.

cops are assholes, just go there and explain what happened (while you're sober) and maybe they'll go easy on ya

ya, just plead ur case they should go easy on you...say something like you were just passing someone or ud just come out of a downhill so your speed was a little high and say youve had a clean record and would like to keep it that way so u dont get demerit points, theyre usually nice.

but in barrie..thats gotta suck its like 5 hours just to go and come back let alone the wait there and stuff

Man would i love that kind of treatment!!!! Hopefully i can get away without losing the points.....my insurance is already killing me!!! BTW, is it true that if the cop doesnt show they dismiss the case!?!?!

Posted by Resnick on Jul-29-2003 21:59:

ya its true..

one of my friends got caught for speeding once, but she started talking to the cop when she got the ticket and they became friends, so the cop just said take the ticket to court in august when im in vacation...and she did and got off

Im wonder if getting a lawyer is going to be worth it now?? It sounds like there are a few loopholes in the system i can risk trying on my own rather than spending $$$$$$ on a lawyer. How much would a lawyer cost approximately for a case like this?

don't go to court, but instead try to settle it before going there, they might lower it, and if you don't like the settlement you can still take it to court, that's what i've done and so far everytime it cost my only 50 bucks and no points .... GOOD LUCK

well you take it to court but you speak to the justice of the peace before you go in, giving you the opportunity to plead guilty to a lesser charge. In most cases this is a $50 fine and no points, knock on wood **tap, tap, tap**

Best bet is to go to a JP like stated before, but that doesn't mean you have to accept what the JP offers.

Any conviction means insurance is going up, the points just determine the severity of the hike, even if the fine get's reduced, doesn't quite mean the points will too. Also, be open, honest, and don't make excuses/bs the JP. They are just doing a job, and the main reason JP meetings help greatly is because it avoids a trial, and lightens their workload

I'd still have an initial meeting with a POINTS type lawyer, since the cop needs to make some sort of case to push the careless driving charge, you may be able to get off.\

Only hope for getting off for you is either the cop doesn't show @ trial, or your lawyer pulls one out. If the lawyer doesn't give you a good chance, don't bother.. you can work out the same lvl of reduction as he can with the JP on your own rather than going to court and have him reduce it with the Crown attorney.

(gee, have I been this route before)

Best of luck
