Help/advice/anything appreciated..

most of you will remember i used to go on about lauren and these photos i used to take of her.
Well now shes gone and used them without my permission and uploaded them to some model sites.
People pay �1.50 a time to look at them, so therefore she is making profit and the website is making profit off them.

i got a bit pissed off and had an email conversation with the webmaster: (read from the bottom upwards..) (ignore the dates also.. my pc thinks is february and i can't be arsed to change it)

what can i do here? shes done it on another website aswell. cosmic babes or some tacky shit. but both are profitting. thats whats pissing me off its not just faceparty or something. THEY ARE MAKING GOD DAMN MONEY FFS.
Am i right to continue these emails and putting forward that im not happy about it and that she was wrong in using the photos without my permission? that said they accept my proof that those photos are mine.

No offense m8 .. yea they are your photos but why are you bothered about her making money off them .. I say let it slide unless you want a cut of the profits?

fraz how did u find out about this?!! i would keep emailing them maybe persistance pays off!? thats not right u should be entiteled to some money but otherwise i mean it is HER in the pics so she can use them how she wants ? i dunno !

because we fell out, i don't talk to her anymore. I can't stand her.
Shes making profit from my photos which she didn't ask permission to upload, and now shes making money from it. Its annoyed me adam thats all

takes a photo of ME... just because im on it doesn't mean i can use it how i want. get me?
im not bothered about money, i just want the photos taking off.

Hmm yea i see your side .. but at the end of the day you got to ask yourself whether its the right thing to be doing, if its over then you should forget about it and move on ..

In terms of clubbing photos permission is usually seeked from the photographed and not the photographer .. seeing as its lauren on the pics surely you took those photos of her to share for both of you?

I'll be blunt and honest here m8 .. to me it seems as though ur angry that shes used the pics you took to make money off what was once a collection from a relationship .. and thats fair enough I guess I would be too .. but is she really doing it to hurt you or is it that they were good photos and shes using the opportunity to make some money off her beauty?? I guess if she was a better person she would have settled it b4 hand or cut you soem profit for helping her out in her new money-maker .. but I guess few ppl think of much else besides themselves and can she be blamed in this instance due to the split-up?

nah, gatecrasher have to buy the photos off paul underhill along with anyone else who wants a copy included the people in the photgraph...


...whoever took the picture has exclusive rights to it as it is their "art" so to speak.

its hard to say... because even though u took them photos, in a sense u gave them to her, so surely she can do what she wants with them? you haven't exactly copyrighted those pics. Plus also, in what context were the pics taken? etc

Another way of looking at it, u know Sarah and Nick? the pause models we used for the promotional postcards? Well i have all the orig pics for them, even though it was took on my camera they can do what they want with them surely. Whereas the ones retouched in photoshop for print use, they will be copyrighted to us.

I understand from ur point of view, but i think its down to copyright of the owner of those photos possibly. Technically speaking she shouldn't of had copies of those pics.

no but yu could theoretically sue sum1 else for using them commercially, as you took them.

i see it like this:

you have proof of conception of the photographs, along with the original data written to your hard drive which will date back further than any other copy of the file (and possibly the original flash card with them still on..?), and this person has used your intellectual property to their own financial gain, which is the very definition of copyright theft in this country.

if it pisses you off then go for it, but if you really want to get rid of all the pics it will take a lot of persuing and a lot of effort, and you have to ask yourself if it pisses you off enough to do all that persuing

she looks like a bit of a slut to me, i say give as many of the pictures to as many pron sites as possible and let the lady's rep slide (or is that the bitchy answer, she's doing it herself anyway whats the harm) and be glad that you are rid of a lady without intergrity.

other than that chase for some from of retribution whether this be financial or the rights to the pics, but to be honest i would let it slide, it all depepnds on your level of pissed off ness i suppose, if she's pushed you to the point of hatred i don't see the point in prolonging the negative emotions surrounding her and the pics

or just offer to sell her the pictures

i'll do it for a couple of days and then probably wont be arsed after that but when i first saw them i it pissed me right off and i had to do something about it.
i can't stand her now, i've needed to get back at her for a month or so now for all the fucking about she caused at new year.
I was the only person she had some "decent" photos took with and to take those away from her or make it clear to her that she has no permission to use them (ie through the website because i don't want to speak to her), it would kick her right in the fucking teeth because it was her "dream" to become a cam model lol.

ed, yeah i understand everything you said there, but me and al took the photos and sent you them with permission to put them on the website, so i guess thats alright. shes took my photos and uploaded them without my permission for financial gain, and like ste said whoeever took the picture has exclusive rights to it as its their art so to speak.

Fraz, technically you are in the right, ther copyright stays with you, and basically it is against the law for them to be publishing copyrighted material. It would have helped your cause to copyright them by typing onto the images but effectively the return argument is rubbish that you can't prove they're yours.

The way you can get around this is to contact their hosting company and tell them that if they do not take your copyrighted content off the site, you'll take further action - its easier for them just to drop the images than bother with an argument, this will prolly pressure the site owner/content manager as well, who i should imagine is who you've been emailing. Hosting companies get well edgy about their clients dealing with unlawful content.

The thing is that the site is prolly hosted by the people who own it, which takes the pressure off them a bit.

Kate does have a good point, you can alway's get back at her with a bit of manipulation along the 'i'd hit it' and 'owned' themes, and start throwing them everywhere - this is likely to bite her on the ass hard, and will make you feel better but its your call really.

I know this may seem harsh to some, but I think you should put the foot down over this, Fraz. Kick up a right good fuss, just go by what Tim said.

This revenge will make you feel a hell of a lot better in the end.

I dont know either of you but I agree with every word. Dont let her get away with fucking you over and benefiting from it. no offense but she obviously hasnt considered your feelings for a second and feels like she's got away with it. You can take that away from her, along with the thing she most wants. Wish you luck

Mate, If you need anyone to help prove that they are yours, Ill be happy to! I have the power of assesment (best judgement) VAT ACT 1994 Section 73 which can be transfered to all matters of personal gain.

So if its a character witness you need to help prove that they are yours, Id be more than happy to help!

Kate, i would have killed somebody for saying she was a slut in the first 3 months that i knew her, because she really wasn't, she was the nicest girl i'd ever met. But then things went wrong and i saw the other side to her, so now im gonna pat you on the back and agree with you

check out the terms and conditions of the site- she's breaking the law- it says recieve permission and consent from the owner of the photos before uploading.

how shallow she is. you're best off out of it. don't think she even really deserves the effort you're about to make. but then revenge is sweet

I didn't notice that Harry... wicked. if it states it on the site as a rule then the site must remove them if they're challenged about permissions.
