Shame / Disagreement Advertising and Spam To A Horrible New Level

*Beep Beep, Beep Beep*

I excitedly run to my phone, hoping to see an SMS from tattersalls to say i am the first winner in their new SMS Lottery, unfortunately not.

Second wish was for it to be someone that i actually knew.

nope -

From A Girl named: Liza.

(the message reads:
Hi. Liza here. I'm looking 4 a real man. If u want 2 meet me or 1000's of other girls txt "flirtme" to 188995. Msgs cost $1.10 inc. GST. Optout @ blueskyfrog.com

edit: Mobile Ph. which sent this msg - 0416-905-406

*sigh*

What absolute shite. I might be single, but i really don't need this shite to be sent to me. I cant believe people will msg this back long enough to make it a viable business.

How can they've been seriously allowed to commission this junk!

Yerr its gay I got all these fucken calls from Lavalife for a while - was always a private number!! The whole worlds fucked by spam They say somethin like 90% of emails circulating the world is spam!

Posted by djway on Apr-23-2004 08:02:

muli and I know all about this

Short version: There are VERY strict laws on SMS spam. These laws come down to a reply to the number saying take me off the list, the user must be removed from the list.

im not gonna reply, because then Telstra win the battle of spam by doing nothing at all but providing the bandwidth for these txt messages.

i'd rather just whinge and delete the sms.

Yea dude hehehe

This is actually in BREACH of the new spam regulations that came into affect on the 11th April.

be sure that you have the express or implied consent of the recipients of any commercial electronic messages whic you send.

THey may get away with it.

Its blueskyfrog who are run by Legion Interactive, give the wankers a call and tell em to get fucked.

THey are our competitors hehehehe

Lol, we haven't been done over here yet, but I'm not sure what sort of issues/rules we do follow. All i know on the legality of it is, there is a new guide line, ADMA LOVE our work (and endorse us) and our only opt out is a reply message.

Mind you, I'm not talking about Premium SMS, which is what the issue is.

Soups/all; Muli's correct. Replying to a Premium SMS will cost you ~$1.10 up to $3.95.

02 8302 5000

They are based in sydney, williams street actually.

Yea wade we do a lot of premium SMS MO/MT. We are fully supported by ADMA, but i suppose having a close relationship with them means we also have to follow their rules strictly.

Premium numbers range from 55c - $4.95 (and with the new 19 sms numbers i think it will go higher ) so be careful, you can easily get ripped off.

Also some providers charge YOU to send you content. Like weather reports etc.. so make sure you check out the costs when you sign up for these things, they can be up to $4.96 also

Posted by muli on Apr-24-2004 05:24:

oh i just realised they have a melb office also

I'm probably wrong, but wouldn't giving out your number eg as part of a promotion or service (like Big Brother voting on TV) imply consent? This assumes of course that they're upfront about the fact that they're going to sell your details to direct marketers....

I thought it was only in breach of the rules if a. there's no opportunity to opt-out, b. you weren't told upfront that you'd be spammed, or c. you didn't consent to them spamming you....

Though I'm probably wrong

Posted by muli on Apr-25-2004 07:09:

yea if you enter a competition etc.. and KNOW that your details will be passed on then thats fine.

But thats only for related material, u can't enter a big brother comp and then get FLIRTME sms, thats wrong.

Well you try and teach yourself how to read an ECG

Posted by 00soups00 on Apr-25-2004 23:03:

you could've read mine...

wait, that was EEG.

i guess they are similar, arent they??

and, the only voting for reality tv crap
that i've done with my mobile, was for
my restaurant rules, when i voted for perth
to stay in..

Posted by webmeister on Apr-26-2004 01:21:

Aren't EEG and ECG tests for completely different organs?

Posted by 00soups00 on Apr-26-2004 01:28:

yeh
upon further thought.

i think ECG is Ecco-Cardio-Gram
which measures the heart.

and EEG is for electronic measurements
of the brain pulses...

i got hooked up with all sorts of things
during my EEG and got show trippy strobe
lights etc.
