Car Accident in Cambridge

So my friend got rear ended yesterday, and these are the results.






and this is what hit him:


Luckily both passengers had only minor injuries.

This happened in Preston, while they were stopped, making a turn into the Argyle Arms Pub.

The car is now parked at CarStar on Lingard in Cambridge.

can you do anything in case of a hit n run?

if a car hit you from behind and fled the scene, leaving substantial damage.

i only caught the 4 first letters of his licenseplate and know only that he's black and drives a black car.

my insurance is one way. witnesses couldn't believe he fled.

sure...give ALL of that info to your insurance company (and hopefully a police report was filed as well).

4 digits of a plate + colour...they should be able to investigate (if they choose to do so)

The insurance company can basically do nothing with a partial plate. They could try and run a plate check with only four digits but I doubt it will be done. If it hasn't been reported to the police then report it right away. The police will have better luck then the insurance will with identifying the at fault party. Best bet is to tell them you were injured in the accident. The police are more likely to do something if someone was hurt then not.

If you were able to get the names and contact numbers for the witnesses, and they corroborate your account of the collision, your insurance company may elect to pay the claim under DCPD. DCPD is a coverage under the liability section of your policy that pays for your damages in not-at-fault accidents. The reason I said may, however, is that in order for DCPD to be triggered not only do you have to be not-at-fault but at least one other vehicle involved needs to be insured in Ontario. While the witnesses may support that you were not at-fault unless the other party is identified no one can confirm he/she was insured in Ontario. All that aside, some insurance companies will are "kinder" then others and don't always take a strict interpretation of the policy. Personally, I wouldn't extend coverage, however, I have been instructed to do so by insurers in the past.

What's the point of DCPD anyways if you have to prove that the other car had insurance coverage in Ontario? If you discovered who the hit & run driver at fault was, and say they are insured in Ontario, then their insurance company would cover it anyways, leaving no need for DCPD, right?

Nat, I'm not on either side. Insurance is a contract between the insurer and the insured. My job is to make sure that both sides meet their obligations under that contract, no more, no less. If one of the parties chooses to go beyond their obligations that is up to them but as the person charged with making sure that both sides best interests are served I cannot recommend it.

Normally proving that at least one other party has liability coverage in Ontario is not a problem (except in hit and runs). If both vehicles involved have insurance in ontario then the insurers of each vehicle pay for that vehicle's damage.
If you are insured by RBC and I am insured by Pilot and I rear end you then it would break down like this.... I would be at fault, RBC would pay your damages under DCPD, Pilot would pay my damages under collision (if I have collision coverage).
Now, say you have coverage through RBC and I am uninsured.... RBC would pay your damages under collision (if you have it) and then they could sue me to recover what they paid. If you don't have collision you would have to sue me. The same would be true if I were insured by a company that doesn't write insurance in Ontario... say I were from Florida and insured with Geico, then RBC would sue Geico to recover.

Yep it's a big conspiracy and we're all out to screw you. I just recently paid $790,000 in damages to a young man that was struck by a car while crossing a street in Calgary.... I paid so much because he's 31 incapable of walking without a walker, cannot lift anything weighing over 25lbs, and subsequently will never work again. I bet you he really hates insurance companies because he'd be much happier spending the rest of his life on welfare. I'm pretty sure the person who hit him (waitress) is upset about it too because I know that she was really looking forward to working two jobs for the rest of her life so that she could pay off the court judgment against her.

fuck people like you make me mad, can't think of anything other then your monthly premiums which really pale in comparison with the protection availible to you. But hey, you could always drive with out insurance and just hope for the best..... asswipe!
