Stupid Canadian Justice System

so here is the scenario. i got acused of speeding 91 in a 60 zone. point 1 - my car is 17 yrs old, has about 4 rolls of duct tape being used to temporarily fix numerous problems, front suspension is reduced to springs only as the struts are fuxored, i have no exhaust pas the collector pipes. all in all my car is slow as shit

first and foremost the ticket was bullshit cause i was lucky to be doing sixty at taht point in the road. anyways i send in notice that i want to fight the ticket in court. so i also put a letter in that i will be out of the province and country for most of the summer so i would like a court date in september sometime. they are like fine sure no problem

today i get a summons in the mail for july 7th. ill be in regina SK taht weeikdn for my buddys wedding, so i cant bein ottawa. i head over to the provincial court hosue to get teh trial date changed. and i quote

lady from courthouse: oh thats a problem, well you could send in a friend but i cant guarantee the judge will look favorably on that situation.

me: so it would be better if i showed up and left????



do people even think before they think up these stupid dumbass processes. now im stuck with either taking a guilty charge and having to request an appeal, or tryin to get a friend to take a half day off work to go to court and tell them that i am not going to be there...

fucking stupid legal system

and I'm sure you were not speeding....at the time the cop got you I'm pretty sure you were speeding...if all you got was a ticket for speeding then you should thank your lucky stars and pay the damn thing. Face the music...you were speeding and you got caught....if you can't do the time then don't do the crime.

IMO if you fight a ticket and you loose then you should have your license taken away for at the least 10 years until you grow up and realize there are consequences to your actions.

because clearly fucked up or asshole cops and these fucked up situations never occur and are clearly the drivers fault, right?

Shouldn't be a problem. Just make sure somebody shows up instead of you on the court date and explains why you aren't there, and requests a reschedule. I've done it, no trouble.

usually (for the 1324214321 tickets i have had) if i know i was speeding i just bite the bullet and pay up. but this time i honestyl wasnt. and infact, ok this is going to get really nerdy.....


about 3 weeks ago my buddy and i went out to the site and mapped it out with a gps total station (accurate to the nearest milimeter) the distance from where i turned left onto the road to where i pulled over was 500m on an upgrad of 4%. using the AASHTO method, the stopping sight distance for that scenario is aprox 300m. that gives me 200m of road space to accelerate from 0 to 91 kmph. my car brand new with the turbo still on it, on flat level pavement, and driven by a a professional driver has a 0-60 time of 8 seconds. taking into account taht my car is a huge pile of shit, has no turbo as it got fried, has no exhuast and the lack of back pressure causes some massive power loss problems, i by no means considermyself an pro driver, and i drive that car like a granny 99% of the time cause im affraid it is gonna fall aprat, and the shear fact taht i wasdriving up hill, all these factors in account my acceleration distance was something like 390 m.

this leaves me with 190 magical meters of road that dont exist. not tomention the fact taht i was in 3rd gear when i got pulled over, to be going 91 in 3rd in my car i woudl have been peaking 5500 rpm, which makes the car shake like a bastard and sounds very similar to a dying giraff......

so my conclusion is either the radar gun was out of calibration (even when calibrated they are horribly inacurate (+-20 kmph depending on the angle s etc) or he wasnt pointing it at me.

second of all when i asked for the gun serial number and his badge number when he gave me the ticket, he refused....

Isn't that grounds for dismissal of the case? Or at least if the cop doesn't show up in court.

Not at the time the ticket is issued. The gun, testing cards, and readings are all produceable but not until a statement of defence is filed and served.

My advice would be to contact the crown's office and ask they consent to adjourn to a later date or plead to a reduced fine.

the only reason im fighting it is the principle of the issue. ill admit when im wrong... well most of the time.... but this is bullshit and 2 points is 2 points no matter what the fine is. 100 bucks is nothing but its the points im pissed about.

Actually...the canadain dollar got up to over 0.89 US today. It is expected to reach 0.96 US before the end of the year....watch out US canada is gonna take over
