for all you myspace people out there...

i know a few people here recently jumped on the myspace bandwagon, hope you read this!

6. Proprietary Rights in Content on MySpace.com.

1. By displaying or publishing ("posting") any Content, messages, text, files, images, photos, video, sounds, profiles, works of authorship, or any other materials (collectively, "Content") on or through the Services, you hereby grant to MySpace.com, a non-exclusive, fully-paid and royalty-free, worldwide license (with the right to sublicense through unlimited levels of sublicensees) to use, copy, modify, adapt, translate, publicly perform, publicly display, store, reproduce, transmit, and distribute such Content on and through the Services. This license will terminate at the time you remove such Content from the Services. Notwithstanding the foregoing, a back-up or residual copy of the Content posted by you may remain on the MySpace.com servers after you have removed the Content from the Services, and MySpace.com retains the rights to those copies. You represent and warrant that: (i) you own the Content posted by you on or through the Services or otherwise have the right to grant the license set forth in this section, and (ii) the posting of your Content on or through the Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to or through the Services.

so yeah the aspiring producers might want to take note

nah they're too pussy to do that
they're just all talk.

Posted by jono4L on May-01-2006 12:33:

thats pretty full on, they could start their own record label with the amount of producers who put their stuff up there. not only that, they could have all the tracks recorded under the production alias "myspace". that would be some pretty good marketing.

pfft who reads the fine print anyway

Re: for all you myspace people out there...

I believe microsoft has a similar clause for hotmail with respect to anything you send via hotmail becomes property of Microsoft

Most producers i know only have small samples of their work (which would therefore only be the portion that pertains to the licence), but if something is unsigned and on there for that reason, as soon as it's signed all you need to do is take it off and the licence no longer exists.

Interesting read though

yeah but it also says that any backups or copies myspace makes of stuff on there remains theirs and they have the rights to those copies. so yeah hopefully nobody has full tracks on there!

One of my friends followed through. He was emo, he has MySpace, as do I. Generalisation much :P

I'm starting to think that you're em0 yourself since you seem to be the resident em0 authority...

Posted by Light The Fuse on May-02-2006 04:12:

but say like the track the artist puts up is already signed - ie Nicholas Bennison has Revention up there - its already on propulsion. Doesnt the label own the rights? so how can myspace as well?

(as u can tell im no lawyer)

Posted by Aesthetic on May-02-2006 06:07:

Are they putting up full tracks or samples? It's ok to share samples of your work, thats the way people promote

Posted by Chris Pana on May-02-2006 06:08:

beat me to it begic boy. Your own works are fine, just can't have a green day tune playing

Posted by Dean Millson on May-02-2006 06:35:

but that's the point as they're not quite according to the conditions.

if it's unsigned then you're assigning a licence to myspace.

if it is signed, no matter if it's your work, it's not different to putting a greenday tune up you still don't own the sound recording of it anymore, and what those conditions are implying is that whatever you put on your page becomes myspace's meaning that you can be caught in the middle between say a label and myspace.

it's all a little bit speculative at the moment if you ask me. as if it would evber happen, but it is there in writing.

once again, i say never put full tunes, only samples - but that's commom sense anywhere.

maddox sums it all up pretty well...

quote:

Nobody cares that you took a nap, really.

Bloggers are ruining the internet. What are \"bloggers\"? They're fat--usually gothic--losers who keep web logs instead of hanging out with friends because they wet the bed and don't have any. A web log is a type of online diary where people who aren't important can pretend to be by writing to an imaginary audience. Girls are notorious for keeping these. On a typical site, you'll find a 17 year old girl with hundreds of webcam pictures of herself pasted everywhere, an Amazon wish list so they can exploit wankers that visit their site, and about 2 gigs worth of text documenting every time they took a shit, had an epiphany about taking a shit or ate something (all written in extremely stylish, yet IMPOSSIBLE TO READ micro-font).

Here is an actual quote from a web log I happened across in my referral logs today: \"I took the best nap today.. so so great. And I ate a sandwich, but it wasnt that great, and it kinda made me sick... but it's better than nothing.\"

So the question is: does anybody in the universe care about Ms. X who had \"the best nap today\" or that she ate a mediocre sandwich? I don't, which is why I promptly uninstalled my browser and punched some guy sitting next to me. The page goes on and on about how she's bored, tired, depressed, lonely, hungry, frustrated, etc, etc, etc. I can't remember the last time I wanted somebody's fingers to break so badly.
