CRICKETS IN THE COURT BUG JUDGE, APPEAL DISMISSED

A Yellowknife man convicted of mischief for releasing live crickets in the city's courthouse has lost his appeal.

Mark Bogan, a fathers rights activist, was charged after releasing crickets in a Yellowknife courtroom and at then MP Ethel Blondin Andrew's office in May 2005.

Bogan told the court he released the insects to draw public attention to the bias against divorced fathers in child custody cases.

A divorced father himself, Bogan argued his actions were not only justified, but he had a duty to release the bugs.

Bogan said his non-violent disobedience followed in the footsteps of civil rights leaders Martin Luther King and Mahatma Gandhi.

However, Justice John Vertes said the law doesn't see it that way. He said illegal acts do not become legal just because they are political protests.

Vertes upheld Bogan's mischief conviction, his $550 fine and six months probation.
