Bar Patio owner forced to buiild two useless walls thanks to smoking law

This is almost as stupid as not allowing truck drivers to smoke in their rigs!

Scott Mcnair, owner of the Devil's Advocate on Bay Street, has been told he'll have to install two fences down the middle of his smoking patio if he wants to be on the right side of the new tobacco control law.

The fences must separate the tables in the open air from those under a building overhang. One part of the overhang is three stories up.

"Of course, it's silly," Mcnair said.

Ontario's new smoking ban outlaws puffing on any bar or restaurant patio that is even partially covered.


Mcnair said a public health inspector told him that the law applies even if the overhang is eight stories up.

ONE FENCE NOT ENOUGH

"I said, 'You've got to be kidding,'" Mcnair said. "He said, 'Nope.'"

The inspector has told Mcnair one fence dividing the tables is not enough; he must install two fences with a gap in between.

The Devil's Advocate did not have a designated smoking room, and depends heavily on the summer patio smoking trade.

The patio rules are one of the more contentious aspects of the Smoke-Free Ontario Act, which came into effect this week. Although the province brought in the law, municipal public health units are responsible for enforcing it. Hospitality sector representatives have complained the rules are unevenly applied, and with patios, make little sense.

as many stupid examples of this law as i find. Yes im very passionate about this because it affects my paycheque and lifestyle.

Not really, since there is an intended net benefit to the bylaw in place. Can't really think of one for tiesto

Iam not surprised if we get attacked by some terrorists,since our new government thinks and and makes it is decisions to please G.W. Bush.

It's even more bizarre in Calgary where you can smoke inside but not outside on the patio....figure that out. "I'll be back..I'm going inside to smoke"

You can relate just about anything to tiesto. he's like 2 degrees of separation from everything.

hey, just a question?

people at work keep asking me where to smoke - i just say go for a walk and then they seem to think that you are not able to smoke on the sidewalk either. I think that's complete BS. We are not allowed to smoke on the property here anymore! I don't mind walking around the neighbourhood at all, I usually do anyways but is there truth to my coworkers thinking that we can not smoke while walking on the sidewalk?
