When your real name is someone else's DJ / producing alias...

I wouldn't even care too much except for he has releases scheduled under that name (so now I don't want to release under that name to avoid confusion), and I guess he had the "name" first as far as music goes.

Dammit. And I just changed my MySpace page over to that one so that I would have a music page / new URL. My MySpace friends would be pissed if I made them re-befriend me AGAIN, heh.

+1...I learned that from the Gene Simmons show on E. According to him there was a 'Kiss' before 'Kiss'. But the people who had the name Kiss never copyrighted it. Gene Simmons copyrighted the name and owned all rights to the name, making it his! nyk nyk nykk

Plus I'm not exactly out to screw the guy over, but I'm not sure what to do. I really don't want to have to get a cheesy alias, and I dunno if I could think of something I like.

I too have a name exactly like this dj from New York, which happens to be where I'm from. Lucky for me I don't plan on releasing anything. There's a way to get around this. In each country there is an artist registry which is legally binding which you can use against somebody else if they claim to be the real [insert name here]. Since we're talking about the U.S. here, then get your name in the system and as someone said before copyright all your stuff. It's basically a matter of who gets there first. Talk to your label about that registry stuff or google it. I don't know the exact details.

This is kind of crazy to see this all going on but I know David Michael. He was a DJ and used to spin here in Seattle quite a bit 3-4 years back. I haven't spoken to him in years though and always wondered what happened to him. Now I know. He was always a super nice guy. I'm sure you guys can work something out.

If you are born with a name, you can use it to do whatever you choose.

This other David Michael cannot legally stop you from using your birth name to record or perform under.

A person can trademark an artist name, which prevents any other person from using that name in the same industry --- with the EXCEPTION of a person who has the same birth name.

Also, it does not matter who was born first.

That being said, you may wish to change your artist name to avoid confusion.
