the 'i just fell on a patch of ice' thread.

ugggggh.

so i make it through to the month of march without the dreaded wipe out on ice - but today, i took a HARD tumble...... which really shouldn't have happened - but due to me being an idiot, it did.

i leave the house this morning in a rush (big surprise, jeff is late) - so i hop in the car and drive off. about five minutes into the drive, i realize i left my cell phone. i pull the 'u-ee' and head back. no parking on the street, so i pull up on the curb. i take one step out of the car then... WHAMMMMO. i slip right away, with the door of my car still open. on my journey to the concrete, i smack my head on the side of my car, and break my fall with my hand (no glove).

headache, big bump on my head, swollen hand, great start to the morning fuck.

I was going to say - if it wasn't your property I'd file an injury claim.

Really? I always thought that law was a bit much. I can see if its excessive, but suing just because you slipped on some ice? When does somebody become responsible for their own balance?

I know why the law is in place, but still...

It's a simple tort claim: property owner not taking "duty of care" to clear snow and ice. Snow/ice caused me to fall and injure myself. The injury caused financial and physical damages. I sue to recover damages.

This is a good reason why everybody should carry a personal liability policy. One never knows when someone litigious person is going to try and recover damages (caused by who knows what).

lol! americans sue for everything.... when i was in the carribean they told me often times when americans come to go scuba diving etc they wont let them come because of insurance reasons and for fear if they get stung by a jelly fish, or somethign rediculous, they will get sued.... too funny.

Jeff...you have a great Accident Benefits claim just sitting in your lap with your automobile insurance company.....you will need at least 30-40 sessions of physiotherapy, psychological counselling, housekeeping assistance, attendant care assistance....oh I could go on and on.

Acutally RJ this is not a tort claim but an Accident Benefits claim under his own automobile policy. He hurt himself in the normal use and operation of the automobile therefore, the medical benefits would fall under the Statutory Accident Benefits Schedule. There can still be a tort claim against the owner of the property or the property management company.

I said if it was someone else's property he would have a tort claim (which you agreed to). However - he's not going to sue himself for negligence. LOL!

the tort claim would only be for pain and suffering....and not for things that are covered under the automobile coverage...the primary coverage is the auto policy...so yes I agree but its not a simple tort claim by any means...besides...you can get more money from the auto claim anyhow.

but what if u fell, say, on someone else's property that you should never have been on in the first place?

ie. maybe u walked up the neighbour's driveway to cut across his grass to ur doorway, bc it was shorter than walking up the sidewalk to ur own driveway and then to ur door.

... but u slipped and fell on the neightbour's driveway.


you never should have been on his property in the first place in this case.
