TA got me fired..

yup. i was fired today for being on tranceaddict. i wasn't watching porn, learning how to build a bomb, or learning how do to inside trading.. nope, i was just on the forums posting.. how fucking lame.

^^^ yeah, seriously...mere surfing is rarely "just cause" for termination unless you were explictly and formally warned or it's in your employment agreement...or were still on probation.

I'd look into that.

oh they warned me. but the thing is though, that all my other co-workers like 6 of them, we're doing the same thing on other sites and nothing happend to them..

nah, i only did it on down time when there was nothing to do. but whatever. it was a shitty company. im just going to miss my co-workers.

warned on paper? i.e. documented warnings...or just informal? There are relatively specific warning requirements in order to terminate an employee with cause.

even if they illegally fired you, you almost never get your job back if you win a wrongful dismissal suit...but you could net some additional compensation.

meh...look into it, at least.

i was shown no soild proof. but to be honest i really don't think its worth my time fighting it. i already lined up a new job anyways. lol

It doesn't have anything to do with what you were doing, whether it was porn or bombs or TA. All the company cares about is that you weren't doing work. And anyway, with all the stupid threads about drugs and porn on the forum, it certainly can't look good to an employer, even if you weren't participating in those threads while at work.

There is most definitely no legal recourse here. Even if no warning was given, there have been plenty of these cases in court and they have consistently stated that it's OK. Don't bother pursuing litigation; whatever Mark may believe, the case won't hold up, and it'll just cost you more money, which is not a good thing after losing one's job.

I know, I'm an asshole for being unsympathetic, but I keep saying that people need to stop goofing off at work, and they always shrug it off. It's simple: don't take your work home, and don't take your personal life into work. Especially when you've already been warned! If you must take surfing breaks, at least read something conventional like the news.

Lesson learned, I hope.

aw, come on now...without specific details, *no one* here (myself obviously included) is in a position to say for certain that there is or is not legal recourse.

it depends on many factors...such as the length of employment and his wage/salary, and if the company followed THE LAW with regard to termination with just cause.

If he was there for a year, making $10/hour...not worth pursuing, whether a legal termination or not. If it's a higher paying job where he had years of tenure...it could be worth it.

I didn't say to run out and retain a lawyer and take it to court...I said to look into it. anyone can look up the relevant legislation online...or may a free phone call to a lawyer.

whatever...if he has something else lined up, it may be pointless to investigate...but extra severance/settlement pay is worth the time to at least look into it, IMHO.

Ok, I agree with you. Anybody can sue/negotiate due to wrongful dismissal.

However - good luck fighting being fired because of messing around on the internet at work after receiving a warning for such.

But was he formally warned? I surf all the time...we're technically not supposed to surf...but if I was fired, without formal warning, and I stood in front of a judge and said that I surf for 15 minutes to relieve stress and take a breather instead of going for a smoke, and a manager suddenly fired me...well, I don't look so bad, do I? I bet that I would win.

In this case, the relevant issue appears not to be the reason for termination...but rather whether he was formally warned or not (i.e. documented warning).

while there are specific acts that legally justify termination without formal warning...such as insubordination, theft, violence, drug consumption, etc...surfing the net isn't one of them (in most cases).

crappy job, short tenure, low pay...not worth it. longer tenure, high earnings...perhaps.
