'Self-medicating' Mr Pacenza says that seeing his best friend killed in action while they were on patrol in Vietnam in 1969 brought on his post-traumatic stress disorder. He says that his psychological problems have left him addicted to sex, especially adult internet chat rooms. When a fellow employee at IBM told managers that Mr Pacenza was visiting such sites while at work, he was fired. The stated reason was that he visited an internet chat site for a sexual experience after he had previously been warned. James Pacenza's lawyers will argue in court that their client was using the internet to self-medicate as a way of controlling his post traumatic stress disorder. They will also argue that Mr Pacenza's claimed addiction to adult internet sites should be treated in the same way as other employees' addictions to drugs or alcohol. The case has potential implications for employers across America and their attitude towards regulating how their employees use workplace computers.

This is worth taking notice only if the court awards the sex addict his due compensation.

There is no way this guy will get a judgement in his favor; IBM is on very solid ground because their policy is based on the sexual harassment precedents.

In summary:

A St. Louis Cardinals pitcher gets drunk, drives, and then proceeds to ram his SUV into the back of a tow truck that was stopped to help a disabled car, killing the pitcher.

So...was it his fault, since he drove drunk and then rammed his car into the back of a tow truck?

No. The family is suing:

1. The bar where the pitcher was drinking that night
2. The driver of the tow truck and and tow truck company
3. The owner of the disabled car that the tow truck was helping

In other words, the family believes that the fault of the accident is in the bar, because that's where he got drunk, and the tow truck and disabled car, because if they weren't there, he wouldn't have slammed his car into them, killing himself.

It's absolutely ridiculous. Gotta love it.

the family should sue itself becuase it wasn't for his momma and his daddy having hime, he never would have been killed. oh noessss.

seriously tho, they may have a case against the bar for serving him too much, and the truck and the other driver if they weren't parked correctly on the side of the road.

I think it's all trumped by him being drunk, driving and doing so while talking on a cell phone. The bar even states that they offered to call a cab and he refused. Also, I don't know how you can properly park a tow truck or a disabled car. It's pretty much up to where the car decides to disable itself.

It's a case of a family realizing that their cash cow has gone and killed itself and trying to sue anyone in plain sight in order to secure more money. The family is making their son look like even more of an ass postmortem by continuing to drag out the results of his poor judgment via ridiculous lawsuits.

IBM is stupid for not having chat sites blocked.

i'm not sure what the circumstances were, but the fact that he was drunk might not even be important. for instance, if the disabled car owner broke down and drifted straight for a hundred yeards when he could have drifted onto the shoulder, then he would be in trouble because a reasonable would maeuver the car to the side of the road. this may have been the case here. (believe me, this happens. just the other day i saw some idiot driving a luxury car on the freeway with a blown front tire. the guy was going like 45 miles an hour in a 65 speed zone and was creating a traffic hazard. the car was leaning on its front left side and i am positive the driver was aware, or should have been.)

even if the driver wasn't able to drift to the side of the road because there was no emergency shoulder, the person in the disabled car may have been aware that the car had problems and yet did not fix them, instead taking a risk that the car could break down and be a danger to others.

the same hing with the tow truck driver. he could have partially parked on the road (when he could have parked entirely on the the emergency shoulder, or perhaps the truck didn't have on it's emergency lights.

moreover, in some states it's illegal to serve people who appear to be really drunk and some courts have found some bars and partys hosts liable for their guests actions.

you go to work to work, not look at chat rooms. if he cant keep that to his own time then thats his problem, not ibm's. sometimes i wish i was a judge so i could get cases like this and tell the person sueing to get the fuck outta here and stop wasting my time! *smacks gavel*

Isn't there a rule saying "DON'T DRINK AND DRIVE" on commercials, freeways, and bars like uhhh, everywhere??? Gee, I wonder why? Doesn't take a fuckin' geneious to understand that. Seriously. If you are driving drunk to the point where you plow into someone else's car, then it's your god damn, stupid ass, ignorant fault. I hate it how no one takes responsibility for their actions. Well, i guess he can't cuz he's dead. But he's a grown man! He should have known better. God fuckin' Damn. You break a rule that is repeated over and over with the MANY consequences that might follow. the chances of paying the consequence will increase with every consumption of alcohol you drink. Fuckin' idiot if you ask me.

and like NeoPhone said, the family is just as retarded. always gotta point their golden, shit-free finger at someone else so all the stupid people reading what happened and seeing it on television can feel sympathetic for them. And, of course, to get that CHEDDAR!! Fuckin' idiots if you ask me.
