With all the recent discussion on the Royalty Board's decision and copyright law in general I thought id open the floor to broad sweeping rants and thought out statements alike.
Wow I got through the first few paragraphs and got far too upset to finish reading. They're seeking royalties from a Mom & Pop Coffee shop for COVER BANDS?!? Cover bands that play for free!?!? What the hell!!

thank god maybe cover bands will break up and people will make their own music

Just a bit of discussion
ASCAP, along with BMI, collect royalties for songwriters and artists. They are not affiliated with the RIAA. This money is FTMP not going to labels and distributors but to composers. These are non-profit organizations set up to ensure that those who create get their piece of the profits. It is the American equivalent of SESAC.
Most people who decry the owners of copyright and enforcers of property rights do so with a byline supporting an artist receiving their share. In this case, that is exactly what is happening; a non-profit retained by an artist is collecting royalties to distribute amongst it's members.
In this case, the coffee shop hosted a "live preformance" of an ASCAP artist's song (a cover). Similar to playing cds over a store stereo, the owner of the shop is required to license the music from ASCAP (The figures provided in the article break down to about 1.10 per day if ASCAP's fee is annual). It's the wrong way to ensure the composer gets his cut. How the fuck are you supposed to accurately run records on which songs are played where? How is that even a sane thing to do?
i thought that buying the record should be enough no? Like ok you can pay for this record but don't play it for anyone or its extra. Awesome.
