NYTA's: Arena Nightclub - 3 Bottle Minimum "Beat Down"?

Only thing I've read on this was from a blog linked on digg, so take it with a grain of salt - regardless, it's a funny story, and I hope the kid gets his two large if this is all true.

http://gothamist.com/2007/12/31/roughedup_revel.php

quote:

22-year-old Gregory Barnard was having a pretty sweet night with his bros at the Times Square nightclub Arena (pictured) one night over the summer. Fresh out of NYU, the kid spent the evening enjoying a reasonably priced $350 dollar bottle of vodka, watching the clubs far-out video projections, and allegedly getting a beatdown from bouncers for not buying enough booze!

According to Barnard, it all started when the time came to settle the tab and his server seriously harshed the vibe with news of Arenas 3 bottle minimum, which left her no choice but to charge him an extra $700 bucks for two unordered bottles. When Barnard refused, a series of events unfolded that truly capture the essence of the New York nightclub experience:

After running Barnards credit card several times, the waitress claimed it was denied. A bouncer threw him to the floor and held him down while two other bouncers punched and kicked him, he said.

They then picked Barnard up and walked him two blocks to an ATM for more money, but the bank had frozen his card because the waitress had already charged $1,400 on it, swiping the card at least nine times, he said.

So the bouncers dragged him back to the club and held him until the police arrived to arrest him for theft of services a charge which was later dropped. Oh, what a night. Now Barnard is suing Arena for $2 million dollars; he filed suit last week in Manhattan Supreme Court.

Forbes has said that New York City has some of the most expensive bottle service in the country. And whats your worst nightclub bouncer experience maybe we can get a class action going!

Wooooooooooooooooooooooooow

I hate places with a spending minimum. At least in the Westin Restaurant (located at the tip-top of the Westin hotel in Atlanta) they tell you "spend this much or get out" when you first walk in the door.

I find this disgusting like russian vodka

Noted.

Places not to go while in NY.

at least it's the country where suing people comes naturally. But yeah it's disgusting.

Posted by verndogs on Jan-01-2008 22:22:

1. at "reasonably priced" bottle at $350. Even for NYC standards, that's a rip off.

2. I'd sue the hell out of that club if I was in that guy's position. Just inexcusable for the bouncers to beat him up like that.

Posted by MeLLyMeL on Jan-02-2008 02:24:

i'm glad he's suing.

nothing worse then dick bouncers who think they own the club.

Together with complusory tipping, yet more reasons why America's food/drink services suck the big ones

For real! The whole time I was in England my family was paranoid about insulting waiters about tipping. It's just odd (though makes perfectly good sense) for tips to be included.

Unless the guy suffered permanant injuries, 2 mil is a bit excessive.

tips aren't included in the bill, the owner pays his staff a proper wage in the first place and doesn't rely on the customer to pay his/her employees.

Tipping is a reward, not an expectation. Anyone who says otherwise is an idiot.

I totally agree. Tipping waiters is one thing but its insane how many people you have to freaking tip these days.

He can fuckoff with his 2 million.
They can fuckoff with their drinks minimum.

Plus if he can afford a $350 bottle of vodka he can just fuckoff anyway

he should ask them for the extra charges, plus whatever hospital bills he may have incurred, and nothing else. if they refused, then sue them & add on the legal expenses to that bill. enough of this 'be a victim--win the lottery' bullshit.

Clearly you don't understand how tort law works... you always demand an outrageous amount in your Statement of Claim (sorry, Complaint... I forgot I was talking about the US). The reason for this is that when you sue someone you're really suing their insurance carrier and you want to claim the policy limits... this puts more pressure on the insurance carrier to negotiate a settlement.

and thats why i dont go to night clubs anymore.

i blame consumers tho for falling for stupidity.

It used to be that companies would go out of their way to convenience you so you would spend money. when did that change?

I dont go to nightclubs anymore because I dont believe in lining up. I will not go anywhere unless i know the people working the doors.

I have vowed i will never line up like a sheep for any service. I will not wait outside hoping the bouncer picks me to come and spend my money at their establishment. What are we a bunch of fuckin dopes?! how stupid are we? they should be begging me to come into their establishment to spend my hard earned money. This world has gone backwards.

I blame consumers though and how much of a bunch of sheep people have turned into.

FOr example, IN toronto we are such sports freaks that the home teams such as the toronto raptors and toronto maple leafs have made their own channels. The idea was to put a number of games on to these channels and to watch them you need to pay pay per view prices. an idea that would have been squashed way too soon if people just had a little self control and said "No I will not pay for something i already get for free and have been getting for free for years". BUt this idea has blown up now because the moment they did this everyone threw in their creditcards like a bunch of fuckin sheep.

My point being : this world will keep fuckin you straight in the fuckin ass for as long as you let them. Too bad our society consists of 90% fag pussies and will continue to allow this sort of abuse.

Posted by Zoso on Jan-02-2008 20:19:

A 3 bottle minimum? Jesus H., do they pay for your cab ride home? Or do they just expect you to drink all that then get home safely on your own? If I'm buying 3 bottles at $350 a pop, you're damned right I'm drinking 'em.

i like clubs, but some can fuck off with their

"300$ a bottle" service. some friends and myself had bottle service before and the bill came to about 700 dollars or so (we don't get to pour our own drinks, the bottle girl comes and does it for us). i know the club owners laugh at people who spend money like that for drinks...

and some of the clubs i go to, i have to tip people in the damn BATHROOM for handing me a paper towel which is only a hands reach away from me. it's pathetic. i remember in once instance where i was reaching for a paper towel and she quickly gave me one before i could get it. these club owners already make good money for charging 9-13 dollars for drinks, but they go the extra mile to take more money.

let it be known that if he went to such a place in the first place, he had to know what he was getting into. sounds like an asshole who wanted to live out of his means. if you can really pay 350 for one bottle, you can pay for three. if you can't pay for three you shouldn't bother going.

he can go fuck himself
