Brenda Martin made headlines months ago when it was discovered she had been held in a Mexican jail for more than two years without facing trial.

Martin, formerly of Trenton, Ont., finally went to trial Tuesday and was found guilty of fraud.

She and her former boss and maintained her innocence, saying that is was only the employer who knew about the Internet scam.

The Canadian woman was given a five-year sentence and fined 35,800 pesos (roughly $3400 CDN).

The news has worried her supporters: Martin has been under suicide watch at the prison.

Well that is part of the problem. From my understanding, there wasn't much of a case, and it could have been down to Mexican incompetence+corruption. Mexico was just happy letting her sit there and rot, until the government got involved.

It's funny because it actually took Paul Martin's involvement to trigger Harper to do anything. Until PM PM started to get interested and fight for Brenda, Harper washed his hands. Then all of a sudden, it became a big deal and the Fed got involved.

Looks like diplomacy failed in this case. But being convicted and having the world know your story *might* be better than sitting in a jail, in a foreign country without charge.

That is so heartbreaking. So sad.

She will commit suicide soon unfortunately. I listened to her on CBC Radio about 2 months ago when her friend happened to have her on the other line during the radio call. My heart goes out to her. Her trial was unfair, and took her in because they didn't get the big fish.

The Mexican justice system places the onus on the accused to prove his or her innocence -- rather than on the prosecution to prove the guilt of the accused.

She is arrested and held without due process - or access to basic human nessesities for two years.

i do understand her being upset for not having a trial.

but they can't prove that she didn't know she was invloved in fraud. just because her former boss said she wasn't involved. i mean, he is already serving his sentence, what difference does it make to him to lie.

the woman is in bad shape tho. i heard her on CBC and she is quite sad.

It doesn't matter if she IS guilty, a Canadian citizen is being held in a squallid, foreign jail without charge or due process of any kind, and our government is effectively doing nothing.

The government cannot intervene in mexican law just as mexico cannot intervene in canadian law. It sounds like its a sad case and it sounds like the mexican justice system is a joke. That said, mexico is a sovereign country just like canada is which means she is at the mercy of their system. Tourists need to understand that once they leave canada, they leave canada's justice system.

Imagine if the situation were reversed? How many canadians would be outraged that mexico even dare suggest interfering with our due process?

I hope the best for this poor woman but sadly i dont think much more can be done for her other than asking for a penal transfer to canadian prison.

did this HAPPEN in mexico... like ... the actual act of investing in this dudes scam.. cuz if it did.. then she deserves to be in a mexican prison no matter if shes canadian or not... just like if your in taiwan and certain people find you with weed your going straight to jail and the canadian government wont do shit... bottom line.. dont break laws in other countries if you dont know the consequences

OH i also saw.. if you would lik to donate to help pay brenda's legal fees click here.... ummmmm is it just me or did this woman just get out of an 8 million$ SCAM lol you would think they had some put away or buried just in case they got caught? lol

The guy was a con man, and she worked for him as a chef. I think there is reasonable doubt as to whether she knew it was a scam. Remember he bilked people out of millions of dollars, which means he was good at what he did, so to convince one more person (especially somebody who was not involved with financing) would not be that hard.

She's been threatening suicide since this whole thing began.

The lady doth protest too much. IMO

She'll be released soon enough.

Once she gets transfered to a Canadian Prison she'll be let go in a due time.
