Hoare won �7 million -- about $12.8 million at the time -- when he bought a winning lottery ticket in 2004 while spending a few hours outside prison under supervision. He received his money when he was released in 2005, after serving 16 years of a life sentence for attacking Mrs. A. He had six previous convictions for sexual assaults and rape.

Mrs. A sought to sue Hoare when she learned about his winnings. But she was initially told the time limit for compensation claims had run out, with such claims allowed only up to six years after a crime.

On Tuesday, Judge Peter Coulson ruled she could pursue the lawsuit, saying he accepted that Mrs. A did not sue Hoare immediately after the attack because the convict did not have funds that would make a financial claim worthwhile.

Coulson stressed that the case was exceptional and should not lead to many people trying to sue long after the statute of limitation runs out.

"It will be even rarer for such a defendant, years later, to buy a lottery ticket which wins him 7 million pounds or otherwise comes into an unexpected fortune which makes him suddenly worth pursuing after all," the judge said.

In a statement that formed part of the court ruling, Mrs. A said: "I very strongly believe he should be held accountable to me for his attack on me and the physiological damage the attack caused me over the years. The attack fundamentally changed me and I am not the person I used to be."

I don't agree with suing, but I think it's perfectly fair for her to take his money.

I might have agreed with it had it been within a reasonable amount of time after the incident occurred. However, my qualm with this is that it's blatantly someone going, "Oh, shit! Look! I can get a lot of money! SWEET!". It's been almost twenty years and she's only doing this because he won a shitload of money and she sees it as an opportunity.

I kind of agree, but this scenario makes a mockery of the statute of limitations. Extreme or not, if it she wins it'll open up plenty of retardedness, and the retarded people will have some kind of precedent to base their own 'extreme' cases on.

I completely agree with you.

However, if you were raped, do you think you'd EVER get over hating the person who did it?

It must be a horrible experience, and I can totally understand where she is coming from trying to screw this guy over down the line.

ok seriously, the british justice system sucks. How a guy who's in prison can buy a lotto ticket to begin with is astounding. It's no deterrent for them, we keep letting people out earlier & earlier. We need life without parole & put all the ****s on it who do shit like this/murder/abuse etc.

I can only see this as a good thing. I mean what would a guy like that do with 7 million quid anyway? Hire a really good lawyer that will get him off the next time he rapes someone?

I would think this is ridiculous for her to sue for something that happened nearly 20 years ago, but the woman has to deal with the memories of being raped for the rest of her life. I think she's doing it not only for financial reasons, but also for revenge.

If you got raped, I think you'd want the rapist's jackpot 20 years later too. Although 16 years is a lot of time in jail. Gray area to me.
