"... The mere fact that the figure depicted departed from a realistic representation in some respects of a human being did not mean that such a figure was not a 'person'." In dismissing the appeal, the judge ordered each party to pay its own legal costs in the first case dealing with the "difficult" issue.

not sure i agree with this. banning child abuse products is about preventing children from being harmed in the making of such products. i fail to see the victim here. not really any different to above-age actors pretending to be underage (ala recent SVU episode).

To call a fictional animated character a 'person' is going way overboard, IMO.

It said he was in the process of appealing a kiddy porn charge from February. Doesn't sound like the same case to me. Maybe I'm wrong though.
