To the douchebag jwalking in the snowstorm:

Thank you for causing me to swerve to avoid you thereby crashing my car into the curb at 30 km/h. Thank you for also having the concience to yell and swear at me for almost hitting you after i saved your life. Thank you for sticking me with a day off work and a $400 repair bill. Thank you for being like almost every other self rightious pedestrian in our wonderful city.

Moral of the story.... next time ill just hit the ******

Cars are bad enough... But pedestrians in toronto walk around like they are Ironman or something

I call those ******'s bonus points while driving..............Sorry for your loss hey $400.00 is still better that being sued for something really life threating that could have caused the dood to not sleep at night and have a broken neck at the speed of 30km/hr and send you paper in the mail with lots of zero's in the end.

Posted by Silky Johnson on Dec-09-2008 15:11:

Yeah some fag gave us a dirty look as we passed him on the ROAD, like we were abusing the road by DRIVING ON IT...y'know, like cars are supposed to. Fucking moron.

Posted by elFreak on Dec-09-2008 15:15:

we need the government to step in and make some bans on this.

thats the only reason i swerved. We need to change the law. If you are jwalking and get hit its your own damned fault. Now im stuck with the bill and jerk off is probably out jwalking somewhere else.

I also like playing chicken with the bicyclists on my one way street. When they come down the wrong way in the middle of the road i just start honking and flashing my beams. They get the message real quick. As they are a vehicle breaking the law, im hoping that if i hit them it will be them who gets charged.

not bans, but they should put the responsibility on the one who is actually jwalking instead of the driver who is put into a precarious position

since i moved downtown ive stopped stopping to let people cross the street. A lot of them inch into your lane expecting you to stop. Fuckem... i just keep going and get the dirty looks

i'm pretty sure even if you hit him it would be his fault anyways, you can just say he was jwalking and you couldn't stop
just a lot of shit and headache to deal with..

im going to find out. If this really is the case then pedestrians had better watch out because im sick of their arrogance.

PS im always the FIRST one to stop at a crosswalk and give pedstrians their right of way.

Posted by Silky Johnson on Dec-09-2008 15:31:

Do you really think it's arrogance? Or is it just cluelessness? Because to suggest that these people are arrogant would imply some higher level of thinking and/or consciousness, and I really doubt that. People are fucking stupid. You just know the soundtrack to their life is fucking circus music or some shit.

Posted by KaiLee on Dec-09-2008 15:36:

It baffles me how much people jaywalk in Toronto...then are able to sue the person that hit them when the jaywalking diptards were the ones breaking the law in the first place! Cops need to be stricter on issuing people who jaywalk tickets versus filling up their quota with handing out tickets to homeless people.

Try that shit in China and you get clipped and/or squished....pedestrians are lowest on the traffic food chain next to crippled people and dogs.

I think its a combination. I know of people who brag that they make cars stop in the road because "if they hit me ill sue them". So its arrogance, ignorance, carelessness, and douchebaggyness all in one.

All i know is that these days my horn and high beams get a pretty good work out downtown.

This is how it works in most of the world. But this is canada. We like to make life difficult for those who we think have it easy.

this is why you should use public transit

Unfortunately, that would result in a larger repair bill (people can cause quite a bit of damage) and tort liability... but at least you have insurance for the liability.

Okay, now you're in my world (Bodily injury claims are my specialty). Unfortunately, just about every North American jurisdiction (Ontario included) has a Revers Onus of Proof when it comes to collisions between motor vehicles and pedestrians. This means that the driver of the automobile is automatically presumed negligent unless they can prove that the pedestrian was negligent. This is exceedingly difficult to do (out of several hundred pedestrian accidents I've handled I've only gotten our driver completely off on four... and two of those were suicides). In a situation like this the courts would likely find the pedestrian to be anywhere from 10-25% liable for the accident (10% for crossing not at a pedestrian crosswalk is the standard... it could be upped to 25% depending on a number of other factors). Ultimately, the courts take the view that the driver should be ever vigilant for pedestrians and always be able to avoid them. Personally, I think the judges are just being lazy or overly sympathetic (judges tend to want to give injured people money and in this case the insurance company is the only one who has any); however, that is the reality of the situation at present.

There was a young mom with a kid in an umbrella stroller on the side of the street (on Haida for you Jay) instead of the sidewalk. She risked her and her kid's life pushing the flimsy stroller instead of just carrying ther kid and walking on the sidewalk, which was easy to walk on, but slushy for a cheap stroller.

No thanks... Here is the break down

Car = 10 mins and $3 for an hour of parking plus about $1 gas

TTC = 30-45 mins and $5.50 for return fare. Exponential if you have passengers.

TTC is just not worth it.
