It all depends on the laws of the state. Washington, for instance, makes it legal for anybody no older than 21 to have consensual sex with a 16 year-old, and no older than (I believe) 22 to have consensual sex with a 17 year-old. If this had taken place in Washington then, regardless of what he believed her age was, it would still be illegal.

Florida age on consent is 16 to up to 23. Either way there are girls that are 13 that can easily pass as 16 or 18.
