Border Patrol tased local pastor

Ran into this story earlier today.

Pastor was stopped at checkpoint in AZ and was tased after failure to follow orders. Was not arrested for any specific crime.

I went through a border patrol checkpoint in New Mexico last Friday. The guy asked me several questions which I should have not answered.

Are you an American citizen? (Ok to answer)
Where are you going? (Should not have answered)
Where are you from? (Should not have answered)

This guy, while I feel for his reasoning, was fucking dumb. If a trained drug dog smells, or thinks he/she smells drugs, that is probable cause. He should never have resisted. He was a dumb fuck for resisting.

Also, this guy is a douchebag. He proceeds to treat all officers like a piece of shit. While I hate police, I don't fucking antagonize them either.

I agree to a certain extent. We do not have access to video evidence of the dog barking or not barking @ the pastor's car. So we really don't know what set the cops off to begin with. That's a major piece of the puzzle which happens to be missing.

It's the guys own fault. He wouldn't answer their questions, he wouldn't get out of the car when they asked him to, and then he acted like a douche by pulling out the camera and antagonizing them. How do they know he isn't trying to buy time so a bomb can go off, or that he isn't intending on pulling out a weapon and trying to kill one of them?

I don't agree with them beating the shit out of him, but I don't blame them for forcefully getting him out of the vehicle. They should have just arrested him and tossed him into jail. The beating was overboard IMO.

Agreed, but even if we did, we aren't trained in this shit. You leave that to the professionals.

They used excessive force for sure, but the guy just needs to shut the fuck up.

The camera was not antagonizing. The way he was acting was. Cops here are fully aware of the citizens rights to film them in almost any situation without the legal worry of being arrested. Do people still get arrested and never charged though? Yes.

I have been in situations where I should refuse to answer the questions, but financially it made no sense. My car was out of registration and they could have impounded.

lol agreed on the racialist aspect, but in SoCal we have some pretty abusive police that think they are the fucking shit. Especially in a select few neighborhoods where they will pull you over for driving a beater. You broke no laws, but because you drive an old car, you get pulled over.

are you really that dense? he was being illegally detained without probable cause or even being charged with anything. you are only required to stop and say yes/no to being a citizen nothing else

so 4th amendment straight up protects against illegal search and seizure and that right was completely violated not to mention use of excessive force

they're allowed to have checkpoints anywhere within 150 miles of the border or oceans most major cities are in that area which is pretty much a no constitution zone look it up

and i always refuse searches even if i'm not doing anything illegal because that is my right. if you don't exercise your rights you will lose them
