Lawsuit claims McDonald's burgers and fries are making kids fat

NEW YORK (AP) -- Are Big Macs hazardous to children's health?

Lawyers have filed a class-action lawsuit against McDonald's on behalf of New York children who have suffered health problems, including diabetes, high blood pressure, and obesity.

In federal court in Manhattan on Wednesday, a lawyer alleged that the fast-food chain has created a national epidemic of obese children. Samuel Hirsch argued that the high fat, sugar and cholesterol content of McDonald's food is "a very insipid, toxic kind of thing" when ingested regularly by young kids.

The plaintiffs include a Bronx teen who ate every meal at McDonald's for three years while living in a homeless shelter. Another is a 13-year-old boy from Staten Island who says he ate at McDonald's food three to four times a week and is now 5-foot-4 and 278 pounds.

McDonald's lawyer Brad Lerman insisted the lawsuit was a frivolous attempt to cash in on the Golden Arches, "the kind of lawsuit that shouldn't be in court."

"People don't go to sleep thin and wake up obese," Lerman said. "The understanding and comprehension of what hamburgers and french fries do has been with us for a long, long time."

McDonald's has asked Judge Robert Sweet to dismiss the case, arguing those who filed the claims cannot show their health woes were caused by Big Macs and insisting the company has never misled customers about its food. The judge did not immediately rule on the request.

you're kidding? Maybe the recipes are different in Israel, I kow the mcDonalds I visited in Germany was a bit dodgy.

The ironic thing is, the lawsuit should have nothing to do with the McDonalds franchise itself, rather it is a portrayal of how sad American society is. We have homeless children suffering from obesity? This shows that government aid is going wrong somewhere.
And it is a fact that it is cheaper to eat very unhealthy food in America -- fruit, for example,is often highly overpriced, and of poor quality. IT's funny how the most economically prosperous country mostly food that an Ethiopian beggar would spit out. Thats the first thing I noted when I emigrated from Russia. Even though at home rations were limited, the food was amazing.
As far as the lawsuit, I'd have to agree with the defense in that it is irrelevant and beside the point.

well if stupid people can sue cigarette companies for selling a product that gave them cancer, the same can go for McDs.

sure, fatty foods arent necessarily as addictive as nicotine and they arent technically a drug, but people with eating disorders(not anorexia) might have issues.

basically it all comes down to stupid people. i dont agree with either form of lawsuit. if people knew what they were getting, and were smart about it, they wouldnt smoke and wouldnt eat McDs. im not saying i do neither tho, cause im guilty too - but i know when not to engorge myself and sue|

I heard about this kind of thing awhile ago...not this story in particular though. I heard some lawyer was going to sue McDonald's and other fast food restaurants because he claimed the food contained chemicals and such that were making people sick. It's really bullshit...people obviously know the food is bad for them and they're not going to start putting warnings on food any time soon I don't think.
This is just like those idiots who smoke all their lives and then sue the cigarette companies...I mean, come on, you know you made yourself sick.

I totaly agree with you Fir3start3r!
but, unfortunatly, you have some irresponsible parents, and kids that don't listen to their parents...

so yea, it's kinda stupid to sue mc for that reason, but then again.... people shouldn't be allowed to eat that food! no matter how good people think the food tastes, which i don't see how they would enjoy pure grade A meat....... IT'S BAD FOOD!!!!
But i understand now then people are in a rush and don't have time, so they stop by for some 'fast food'....which explains the long lines EVERY morning on the drive thru....and..then it becomes a habbit....
but i also understand when you're hungry and have nowhere else to eat, and eat cheap ofcourse..... we all do that....

sorry, i don't wanna hate! but sometimes the evil side of me takes over...

this reminds me of a montel williams show where they were showing these kids, one kid in particular was like 100 some pounds at 16 weeks old and the mom was just feeding it crap food like mcdonald's, burger king and what not. and she was on there crying about how she wishes her kid wasnt so big and yet she takes no responsibility for her actions of feeding the kid that garbage. when your that young you can't make decisions like that. its sad that people can be so dumb.

Personally, I got no respect for people who try and sue Tobacco companies and fast food giants, because "they made me do it!!!" More like no self control you pathetic people; and you cant do squat about it, so you go and sue them

Next thing, you'll get kids sueing trading card companies for making them buy boxes of cards, and so on, so on... sigh.

yea, but what about the ads.... sure people make their own decisions, but before they wern't told how bad it is, and instead they see ads about how cool it is....

but you do have a point.....people can't sue if they made the decision.... maybe you can sue for bad ads....????

mcdonalds only provide a service for the consumers! they cant be held responsible if some one eats 13 big macs 3 cheese burgers washed down by 8 packs of fries and an ice cream sundae! at the end of the day its the consumer who eats it and mcdonalds can only be held responsible for providing a service which sells food!
