Drinking in Public

Just wanna make sure that I got this strait.

Last year I was able to walk around south beach with drinks in those red solo cups and didnt get hassled. I was also drinking on the beach just out of bottles and didnt get any hassle.

Is that legal? or was I just lucky?

not legal, but they won't usually hassle you for cups unless they're overly bored, or you're disturbing the public.

quote:
Florida's Open Container Law - Open containers of alcoholic beverages are not allowed within vehicles in the state of Florida. But wait, there's more to this law: Open containers of alcoholic beverages are not allowed within 50 feet of a public thoroughfare. This means not only can you not have open containers while driving (or your passengers or within the driver's reach), you can't walk along the side of a road with an open container.

Florida State Law requires that YOU MUST BE 21 TO PURCHASE, CONSUME OR POSSESS alcoholic beverages. Open alcoholic containers on public property, including streets, sidewalks, or inside a vehicle is prohibited. A person of legal age cannot sell or provide alcoholic beverages to any person under age.

It is against the law to take ANY glass container on the beach.

actually just found out today that drinking any alcohol on the beach itself (in the sand) is illegal. a cop told us today that it didn't matter if it was canned or not, but he said that it is so loosely enforced to not worry about it.

he said if you were to drink on the beach, drink in cans since glass for sure is illegal, and to just be smart about it and not to basically flaunt it (meaning if you have an 18 pack with a couple friends, don't have the entire box out and cans all over the place. keep everything in the cooler except for the drink you are actually drinking at the moment).

Glass container on any beach in Miami is against the law. Best advice os grab a few of those super size plastic cups you can get at any fast food & use those to drink out of. If you are walking around make sure you use any water bottle & fill it up with liquor & when ur drink runs low just fill up & keep going.

Also word to the wise keep a cooler in your room.
