My guess is that it'll get struck down by the supreme court ... some of the things in there in no way abide by the constitution.

That depends on how quickly it goes to the supreme court...

They've already got a conservative streak, and if the Bushies can appoint another judge they'll have a solid majority, which means chances for things like the Patriot Act being upheld become much better (or worse...)

Who's to blame for the Patriot Act?

The corrupt and fascist regime which implemented it?

Or the cowardly and complacent people who tolerate or even support it?

Everyone made a big deal of Ashcroft becoming US Attorney General, and how it was a big mistake. Then everyone got complacent. Now everyone is looking at their backside to see Ashcroft biting their ass.
