Bouncer Killed While Enforcing City's New Smoking Ban

APRIL 14TH, 2003

A bouncer at an East Village nightclub was fatally stabbed early Sunday morning while trying to enforce the city’s new smoking ban.

A brawl broke out after the bouncer, 32-year-old Dana Blake, told two brothers that they were not permitted to smoke in the bar, Guernica on Avenue B. Blake tried to eject them, but one of the brothers pulled out a knife and stabbed him in the stomach, police said.

The brothers, Johnathan and Ching Chan, were arrested and charged with assault, before Blake died in the hospital. Prosecutors have not yet upgraded the charges or said who stabbed Blake.

Blake’s older brother said he blames the death on the smoking ban.

Mayor Michael Bloomberg’s spokesman said that the mayor is pleased the police quickly arrested the suspects and that "his thoughts are with the family of the victim."

A ban on smoking at virtually all of the city's bars and restaurants took effect about two weeks ago.


This sucks....just let people smoke in my opinion in a designated Smoking section!

this was NOT caused by the smoking ban. This was caused by a derranged person carrying a weapon into a club. The bouncer did his job, no stabbing was warranted for that. The guilty one is the stabber, simply no excuse.

Agreed
putting the blame on the ban is ignorant and short-sighted
The man who did this was obviously a messed up individual who would've done something stupid like this in a lot of other situations.

the media tries to twist everything... it's totally rediculous to try and establish any reasonable relationship between the smoking ban and this incident... it's almost as if you're saying the law is to blame for the death of a police officer in the line of duty....

Satan (eek!) Smokin ban...

How do u guys think that the smoking ban will be enforced at the Roxy? Do you think they will take all cigarettes away at the front door? How easy do you think it would be to sneak them in?

I can almost see lawyers preparing a "smoker's rage" defense to acquit that maniac.

The stabbing actually happened at Guernica, which is a pretty cool bar not known for craziness like this...

i remember reading somewhere that they let you take them in but you have to smoke them outside on that stairway you have to go on when you exit the place.. if you try smoking inside, they'll shine their lights at you...

Charges Dropped In Death Of Bouncer Enforcing Smoking Ban

Due to a lack of evidence, charges have been dropped against two men arrested in connection with the fatal stabbing of a bouncer trying to enforce the city’s smoking ban at a Manhattan nightclub.

Jonathan and Ching Chan had been charged with assault after the stabbing of Dana Blake at Guernica, in the East Village, early Sunday morning, but prosecutors say they have been released because no witnesses saw either of them stab the bouncer and no weapon was found.

The brothers admitted to fighting with Burke after he told them they couldn’t smoke in the bar, but they denied stabbing him.

The medical examiner is trying to determine if Blake’s wound was caused by a knife or a broken bottle. If he was cut by a bottle, it may have been unintentional, authorities say.

A ban on smoking at virtually all of the city's bars and restaurants took effect about two weeks ago.
