I'm just curious how the MP3-legality debate applies to all the Trance MP3 download sites, including this one.

It's understandable that downloading albums is officially illegal (and discouraged on this site), but what about singles and livesets -- what's the **official** policy there?

For example if you want to capture a liveset, or put up an MP3 single for others to download, -- do you have to seek the author's permission, or is it OK only for promotional stuff? Or are we supposedly expected to delete all the files we download? Are most of the other Trance sites (like Technodron, ShadowZone, -- there are millions of them) illegal? If they are, that would explain why they're disappearing faster than you can blink... For example I just visited EnergyTrance, which used to be a big site, and now it says "RIP" What a sad pun on the word "rip"!

singles would be the same as albums. they sell singles for money too, just as they do albums. they used to have disclaimers on every mp3 site saying "blah blah delete this file within 24 hours or we hold no legal responsibility". they'll never get rid of mp3's, no matter how much they try. whenever they shut down a program like napster, or close a site, there are 10 more waiting for us to use.

U live in the US so I dont know about all your little pety laws.

On the other hand, Ive heard from Certain lawyers that if Napster were based out of Canada it would still be running...our laws are worded different that those in the US, and it could have kept on running.

Right, but arent the RECORD COMPANIES the one making all the deal ?!?! I mean, black hole records is making a deal, and its based on Holland right ?!?! all the big record companies killed napster, and they arent all american ! BMG is german, Sony is japan and so on ... but , a thing that you are right is that the GOV'T got into the napster issue .. wich, in part yes, USA was part of the killing, these proggies should be established in one of those small countries, unknown wich dont force such technological laws.. but then, the big companies will MAKE the country mess up the proggie .. you know how they are.

k..the way I understand it is that the record companies are pressing a lawsuit against napster for promoting the copyright infringement of their materials. This uses US laws...canadian law is apparently different, and the record companies would not(or would have had a harder time) to shut it down.

I dunno about live sets. They don't tend to put live sets on CD and sell them do they? I recon that it'd be unfair if they didn't let ppl download livesets, but it's probably against the law in their opinions, i mean in one live set you'll likely have several lables copyrights infringed upon.

Yeah agreed. I suspect that live sets are still covered by some sort of copyright though, but I doubt anybody cares much because there's not a single organisation with a financial interest in the set. I doubt you'd get a record company trying to stop a live set being distributed because it contains one of their tracks.

Just recording a liveset is illegal.. the djs have a contract.. which says that recording their sets (and spreading them) isnt allowed..

believe me i know.. i asked a clubowner once if he was able to tape a tom harding set and a few others.. But he didnt want to do that cause he might lose the contract he has with these djs..

The dj himself is most likely not prepared to let you tape his set.. cause he will get in trouble with his own contract.. hed get flamed by the manager

And ofcourse the songs played in the sets have their own kind o copyright..

Most sets youll see on the net.. are broadcasted on the radio.. taped.. and put on the net..

I thought live sets were legal, coz it just work of them. Are there any copyrights on it then?

even if you didnt think you were doing anything wrong they would find a way to bust you if they really wanted to.

ALL mp3's are illegal ! (almost all)
unless the owner of the work has given his / her permission for their work to be made into MP3 and made available.
some artists on napster did just that to promote their work . .
if u make a MP3 of eg DJ Tiesto - urban train and keep it on your PC for your use only, it is still illegal but acceptable cos its for your use only.
However once u share that file then its very illegal cos u are letting other ppl who do not have an original copy get the song for free paying no fee's for copyright or for the artist's time and work in making the song, the studio fees for recording and mixing, the promoters for selling it etc etc etc
That applies to all singles, all albums and Livesets.
Livesets are all copyrighted material too, just that the DJ's that spin those tracks have permission from the artists involved to spin those tracks. and if they have bought the vinyls as a good many amature DJ's do then the copyright has been paid for.
but that does not extend to ppl ripping it and distributing it over the internet.

Basicly its easy to remember this
An MP3 is legal if u have made it yourself for your own use say as a back up to a vinyl or a cd
or if the artist has given permission for their work to be made into MP3 and made freely available.

i wish they were legal. basically the only thing i get are livesets because other things are easier to obtain legally.
