no, an american cannot offer a copyrighted song for download to anyone.

yet they can download without fear of legal action.

Interesting , I don't think the RIAA Target the people who fileshare's download off just the person downloading, Its all stupid. Who cares about music sales, all you need to do is watch MTV Cribs to see that they dont need any more cash.
