1. To enter: Access NestleCrunch.com or Butterfinger.com or BabyRuth.com or NestleSweetarts.com between 12:01 a.m. EST on 1/5/04 and 11:59 p.m. EST on 12/31/04 and follow the on-screen instructions to complete the sweepstakes registration form. All entrants must have a valid e-mail address. Limit one (1) entry per person and per e-mail address, regardless of whether more than one person uses the same e-mail address. In case of dispute as to identity of the winner who enters, entry will be declared made by the registered user (meeting eligibility criteria) of the e-mail account, and if a prize is won, it will be awarded to that registered user.
2. Prizes: One (1) Grand Prize winner will receive a 4 day/3 night trip for winner and three guests to Los Angeles with invitation and VIP access to see DJ Paul Oakenfold perform. Prize includes round trip coach air travel from the major airport nearest winner's home to Los Angeles, CA, 3 nights standard hotel accommodations (two rooms, double occupancy), a limo ride to the event, a chance to meet and take pictures with Paul Oakenfold, and the opportunity to spend an afternoon shopping at a Los Angeles area music store with Paul Oakenfold. Winner will receive $500 in cash for their music shopping spree. (ARV up to $7,500). Actual ARV will vary based on place of origin and airfare fluctuation. Timing of the trip will be determined by Sponsor and Paul Oakenfold, and will occur in 2005. Winner and guest must travel together on the same travel itinerary and on dates specified. Flight details are subject to space availability and airline carrier's regulations and conditions apply. Travel restrictions and black out dates may apply. The trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Due to scheduling conflicts, Paul Oakenfold may not be available to attend shopping spree and his appearance cannot be guaranteed. All expenses not specifically stated herein are the sole responsibility of the winner. If the winner is unable to complete the trip on the dates specified by Sponsor, prize will be forfeited and another winner may be chosen. Grand Prize won by a minor, if eligible, will be awarded to the parent or legal guardian and parent or legal guardian must accompany winner as one of the guests.
Three (3) First Prize winners will each receive a Philips MP3 Key Chain. (ARV $149).
Three (3) Second Prize winners will each receive a Philips Digital Camera Key Chain. (ARV $99).
Two hundred (200) Third Prize winners will each receive one full-length CD from one of the artists featured in the Nestlé VIP Music Experience. (ARV $15.99).
No cash substitutions for prizes will be permitted and prizes are non-refundable and non-transferable, except at sole discretion of Sponsor. Sponsor reserves the right to substitute prize of equal or greater value. Limit one prize per person/e-mail address. Federal, state and local taxes are solely the responsibility of the winner. Total ARV for all prizes is up to $11,442.
3. Winner Selection: Winners will be selected in a random drawing from all eligible entries on or about 1/10/05. Odds of winning depend on number of eligible entries received. Winners will be notified by postal mail and/or e-mail on or about 1/25/05. By entering the Sweepstakes, entrants accept and agree to these rules and the decision of the judges, which shall be final. Prize winners will be required to sign a Winner's Agreement and Release and return it by date specified in notification or prize will be forfeited in its entirety and another winner may be selected. Return of any prize or notification as undeliverable will result in disqualification and an alternate winner may be selected. By submitting an entry, a winner agrees to allow use of his or her name, likeness and/or biographical information for promotional purposes (including posting on this Web site), except where prohibited. Guests of Grand Prize winner must sign/return a liability/publicity release prior to ticketing of prize. In the event of non-compliance, a winner's prize will be automatically forfeited.
4. Eligibility: Sweepstakes open to legal residents of the 50 U.S. and District of Columbia, 13 years of age or older, except employees and the families of Nestlé USA, Paul Oakenfold, their affiliates, subsidiaries, promotion and advertising agencies. Nestlé USA, Paul Oakenfold, their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize. Subject to all federal, state and local laws. Void where prohibited or restricted by law.
5. Other Conditions: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this sweepstakes, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control corrupt the administration, security, fairness, integrity or proper play of the sweepstakes. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the sweepstakes by any technical or human errors which may occur in the processing of the entries in the sweepstakes. Sponsor reserves the right to withdraw the transmission of this sweepstakes at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web site or to be acting in violation of the Rules.
