Guys the point of my critique was that the farmer is just as responsible for this "traffic accident" as the cow.
Cows aren't exactly known for their haste and agility - I fail to see why the responsibility does not lie nearly 100% on the driver.

Utah is a no-fault state. i guess that would be relevant if we were talking just property damage, howerever someone can still be crininally negligent when someone is injured or killed in this case.
i hit a deer once and totalled my 5 month old Civic. had to cover the balance of the loan b/c Geico only paid Blue Book value and i paid too much initialy. i frikkin hate deer. i tore that bitch in half.

Well, if the guy has cows, he should keep them in some sort of a safe custody. Maybe the cow waited just behind a sharp curve, so the drivers didn't see it
