Actually I saw this template at Monster Templates. You can download all sorts of web templates and alter them for your needs. There is an option of making it your own but that costs several hundred dollars.

So either F&P donated/sold the design to the template monster or both parties bought the same template...

...a website sells that design as a TEMPLATE. You can spend $30 and get the exact same design. No one stole anything.
