The difference between Canada and those other countries is that the Canadian government decided on a different solution to the problem a long time ago: taxes. I forget exactly how much the levy is, but for every blank tape or CD-R or DVD-R that's bought, a certain percentage of that goes to the recording industry here. That compensates the industry for any losses they may incur (and then some!).
Does that make it "right" for individuals to copy copyrighted material? Not really, but it does mean that if the recording industry decided to start filing lawsuits, there'd be no excuse to continue the levy on blank media and they'd lose A LOT more money that way.
So the attitude of the Canadian courts to the industry is, "bugger off, we took care of this 20 years ago." And rightly so. If the government wants to remove the levy, THEN maybe we can start talking about copyright issues. But for some reason the industry doesn't seem to be pushing to have that levy removed (a mere oversight, I'm sure).
