This will be a very important test as to how far the gov can intrude in our lives
Lets hope they win or we will be facing even more intrusion and social engineering in the future.
| quote: | TORONTO (CP) - Opponents of the country's first provincewide ban on pit bulls argue Ontario's new law will unintentionally apply to too many other dogs.
In announcing a constitutional challenge to the ban, lawyer Clayton Ruby called the law "too vague" and "overly broad." He says the legislation lists a number of breeds that are "substantially similar" to pit bulls. That, he says, will cause confusion for owners and animal-control officers.
The new law forces all dogs covered by the legislation to be muzzled and leashed in public.
Owners who violate the law can face jail time.
Ruby says there is no evidence pit bulls are more dangerous than other breeds.
"A number of experts will say . . . that there is no scientific basis to conclude that pit bulls are any more dangerous than any other dog," Ruby said at a news conference Monday.
"Because the government didn't listen, we're asking the courts to listen."
The legislation captures dogs that are a problem, but also a large number "that are not part of the problem," Ruby said.
"That is a huge number of dogs," he said.
The plaintiff in the case is Catherine Cochrane, 22, who owns an 18-month old pit bull mix female dog named Chess.
Cochrane said Chess is a well behaved dog and shouldn't have to be muzzled because it won't let her learn to be a well socialized dog around other animals.
"I'm afraid that I'm punishing her," Cochrane said.
On Sunday, hundreds of supporters of pit bull-type dogs gathered in front of the provincial legislature to protest.
Those who have been victims of pit-bull attacks, however, said they were pleased the law had finally kicked in.
