Dunno Legal question

If you buy a track on vinyl make a cd bootleg from it
sell it (the vinyl) and
buy the track on mp3 to own the copyrighted music

are you or are you not breaking the law by using that cd?

If you buy the vinyl, and you make a copy on Cd and sell the cd, that it's illegal.

You can not sell a copy of something that you don't own.

Now, when you sell the vinyl you own, to another person, you are transfering the right of owning that record to another person. so you will no longer have that right. Then after you loose that right, you go and buy the mp3, you will get the right again.

SO I think what you mean it's legal.

and say you had an mp3 backup of that vinyl, you no longer have the rights to play that as well, or so i'm told

Well technically, you arent legally allowed to copy vinyl to cd at all- as it breaks the mechanical copyright laws.......

I don't think that's the case, I think that's covered under "fair use". Just like it's considered legal to "rip" a CD to your PC for personal use as long as you maintain ownership of the original CD.

Regardless of any of this, you CAN NOT sell the music whether you own a copy of it or not. Owning a copy for yourself means that you own the right to listen to the music for personal use, it does NOT give you the right to sell it. That's very illegal. You aren't even supposed to play it in a public performance, but that's overlooked because it's essentially free promotion.

When the pro's release mix CD's, they have obtained rights to sell that music from all the artists, and those artists receive royalties.

No- its not overlooked at all. Its legal because all clubs and bars or one off events that perform music have to have a licence to perform music....and this overrides the 'not for public performance' bumph you get on records.Its got nothing to do with free promotion at all.

Yea, but youll never see an EDM artist sue someone for playing their productions publicly, especially since that is the reason why they produce the music.

Yes, that's what I was saying about "fair use".

I think all those laws (at least in the US) came out of the whole VHS debacle in the late 70's/early 80's.

I think that once you pay for the song of your choice, you can do anything you want with it as long as it stays in your possession. Youre allowed to burn it to computer or CD as long as youre not distributing it to other people.
