I cannot comment on the laws in Greece but in Ontario he would be at fault for the collision. Maintaining a safe and functional vehicle is the owner's responsibility. The courts would rule that if the emergancy break failed and/or the "park pin" (automatics) then the vehicle was not kept in a safe and functioning conditions. Therefore he would be negligent in his duty as a vehicle owner. His negligence is the proximate cause of the collision.

Turn your car's wheels toward the curb if you're parked down hill, and put the car in reverse (if manual).
Turn the car's wheels away from the curb if parked up hill, and put the car in 1st (if manual).
If car is automatic, do the wheel thing, because no amount of anything is going to save your ass should that little pin in your transmission that holds you in Park break.
