I had a very broad idea for a story that I was hoping you guys could help me flesh out (since this seems up many of your alleys.) I was wondering how plausible it would be for your normal US citizen of middle-eastern descent (2nd generation American) to possibly be declared an enemy of the state, have his rights stripped away, all with shoddy evidence.

Let me propose a situation (and please let me know if you feel it is unrealistic): A 2nd generation middle-eastern man (40's) has a typical American, middle-class family. One day, FBI (or whoever) storm his house and haul him away. They claim they have him linked to terrorist cells and declare him an enemy of the state. His rights are stripped. But, the case takes an even more drastic turn when the FBI begins investigating this man's son, who is part of a small student group that is basically anti-government, borderline anarchist. So, it is a case where the father could have had relatives back in the middle-east who were tied into terrorism, but the man in the US is completely innocent. However, he is tied in because of his son's activities.

Are there any cases that are similar to this that I could look at?

That lawyer that got charged with being involved with the bombings in spain? I don't remember the details, but it was a case of mistaken identity.

the closest case in the U.S. to that scenario given would be Jose Padilla. only to say he is the only American citizen in custody right now that falls under the current "Unlawful Combatant" statute.

otherwise, there is no other case to my knowledge pending fitting that description.

Seeing as how I believe a lot of you are fluent in this topic, I'll take this a step further...

What do you think could happen to make this scenario to arise? What could he be framed for? Could he be tied to his son if his son was discovered to be a little anarchist (not violent)?

1. enemy of the state is not really a category of defendant/criminal. i think you're probably referring to enemy combatent or unlawful enemy combatent.


2. i suppose anything is plausible, even if if there is no evidence of wrongdoing or the evidence of wrongdoing is flimsy, or the government beleives that evidence can be derived through torture.


3. the story doesn't make sense to me. work on a timeline of events.

his son would have to show, at least, criminal intent. intending what? could be anything, criminal. as far as his parents are concerned, it all depends on the aggressiveness of the DA or prosecutor and sufficient evidence regarding prior knowledge.

Yup..

We're an interesting social beast, having evolved from animals that found a certain niche between the extreme and the weird.

I would say that we can only hope that the next league of government can bring some stability to our human equation, but unfortunately, we seem willing to bastardize ourselves every few generations.

If there's not a cycle here, every 20 years, then I wouldn't know what to base cycles on at all.
