Basically they dont get sued that much because there is a 10 min limitations. So what can you put that is 10 min max ?

-Personal vids ? No problem with music/movies copyrights
-Music videos ? They are already available for free and putting them on youtube helps the promotion
-Trailers ? See above
-2 girls 1 cup ? Well that's just weird

So basically, many copyright owners believe that Youtube and other tubes (with limitations) are actually a win-win situation for youtube and these compagnies. Youtube makes money cause you click their ads, copyright owners get free promotion. Everyone is happy

It's a size limitation not a time limitation, I've watched an entire movie on there before. The reason they avoid lawsuits is because it's user supported, not company supported. YouTube as a company isn't uploading the videos, merely hosting them. And once YouTube finds copyrighted material on the site, they take it down anyway. A lot of stuff finds it's way through the cracks though.

Also some major companies put stuff on youtube themselves. NHL uploads its own videos.

yeah, some ppl see it as a great marketing tool for a product or sport or whatever, others are anal about it, but it all gets removed in the end, so nothing is lost as such.

Plus their lawyers probably give good head.

Shame the SNL videos get taken down as soon as they're uploaded

There actually is a time limitation, you have to have an account with special privileges to post videos longer than 10 mins.

As far as the whole "hosting, not posting" thing goes, I don't think thats exactly right either. Sites like napster and oink got shut down even though they weren't even hosting stuff. I'm pretty sure that if you host it, you're liable for its content.

The reason why they are still allowed to stay in business is that, as you said, they are really good about taking off copyrighted content if the copyright owners request it.

its because of the DMCA in USA.

the DMCA requires that a copyright complain be delivered in writing in order for it to be enforced.

that tedious process coupled with the fact that as soon as one is taken down, another copy of the same thing is uploaded and the copyright holder has to write yet another letter kinda makes it hard to rigorously enforce.

to top it off last year a couple of major labels offered their music video's to youtube because at the end of the day its free advertising for their products.
