yeah, some ppl see it as a great marketing tool for a product or sport or whatever, others are anal about it, but it all gets removed in the end, so nothing is lost as such.
Plus their lawyers probably give good head.

There actually is a time limitation, you have to have an account with special privileges to post videos longer than 10 mins.
As far as the whole "hosting, not posting" thing goes, I don't think thats exactly right either. Sites like napster and oink got shut down even though they weren't even hosting stuff. I'm pretty sure that if you host it, you're liable for its content.
The reason why they are still allowed to stay in business is that, as you said, they are really good about taking off copyrighted content if the copyright owners request it.
