Two, Tyler Riess Perry, 19, Dayton Ross Jones, 20, both from Hopkinsville, will be tried as adults and face charges ranging from the use of a minor in a sexual performance to first-degree sodomy to tampering with evidence. Two others, both 17 of Hopkinsville, face lesser chargers including possession of a performance/viewing matter which includes a minor. The gang-rape was videotaped and shared virally among others.

Kentucky law distinguishes first-degree sodomy from first-degree rape. In sodomy cases, unlike rape, the criminal system there classifies sexual intercourse separately from deviate sexual intercourse, implying homosexual rape is somehow different than heterosexual rape. The punishment for both crimes, which are Class B Felonies, is 10-20 years. It is uncertain what will happen to the two 17-year-olds. Much will depend on how the county prosecutors decide to pursue the case.
